Abstract

In classical life insurance mathematics the obligations of the insurance company towards the policy holders were calculated on artificial conservative assumptions on mortality and interest rates. However, this approach is being superseded by developments in international accounting and solvency standards coupled with other advances enabling a market-based valuation of risk, i.e., its price if traded in a free market. The book describes these approaches, and is the first to explain them in conjunction with more traditional methods. The various chapters address specific aspects of market-based valuation. The exposition integrates methods and results from financial and insurance mathematics, and is based on the entries in a life insurance company's market accounting scheme. The book will be of great interest and use to students and practitioners who need an introduction to this area, and who seek a practical yet sound guide to life insurance accounting and product development.

Abstract

Modern bank insurance is traced to its roots in The Chinese Cornerstone of Modern Banking: The Canton Guaranty System and the Origins of Bank Deposit Insurance 1780-1933 . Frederic Delano Grant, Jr. provides new understandings of the Canton System, collective responsibility for debt at Canton, and the history of deposit insurance. The Canton Guaranty System inspired radical reform in New York in 1829 – the ancestor of all modern deposit insurance. Yet it was never the success imagined, and soon failed. In the Opium War, the Chinese government as implicit guarantor was forced to pay its debts in full on 23 July 1843. The afflictions of the Chinese system, including moral hazard, too big to fail, and unenforced laws, remain familiar today.

Das Problem der römischen Korreal- und Solidarobligationen ist mit der theologischen Frage der Dreieinigkeit zu vergleichen, wie Rudolf von Jhering, einer der berühmtesten Juristen des 19. Jahrhunderts in „Scherz und Ernst in der Jurisprudenz – Eine Weihnachtsgabe für das juristische Publikum“ 1884 formulierte: Es sei schlicht nicht theoretisch lösbar, sondern allenfalls auf rechtspraktischem Wege. Die gewissermaßen überzeitlichen Fragen treten auch heute noch in gleicher Weise auf, etwa wenn Partner einer nichtehelichen Lebensgemeinschaft eine Wohnung anmieten. In der Folge sind beide dem Vermieter zur Zahlung des vollen Mietzinses verpflichtet, der Vermieter soll die Miete insgesamt aber nur einmal erhalten. Obwohl das BGB die römischrechtlichen Ideen nicht vollständig übernommen hat, stellen sich die alten Probleme, wenn auch in neuer Verkleidung, immer wieder und sind letztlich ebenso ungelöst wie die Deutung der antiken Quellen. Die Arbeit Steiners geht zurück an die Wurzeln des römischen Rechts und macht deutlich, daß ein Verständnis der antiken Vorstellungen nur möglich wird, wenn die praktische Umsetzung der überlieferten Quellen im Gerichtsverfahren mit bedacht wird. Es zeigt sich einmal mehr, daß die römischen Juristen keine rechtwissenschaftlichen Glasperlenspiele betrieben haben, sondern solche eher den pandektistischen Lehren des 19. Jahrhunderts zuzurechnen sind, welche auf die Schaffung des BGB maßgeblich eingewirkt haben. Der rechtslogische Mythos der Solidarobligationen löst sich auf, wenn der enorme rechtspraktische Sinn der damaligen Fachjurisprudenz und die römische Prozeßordnung zur Grundlage der Quelleninterpretation gemacht werden.
