Abstract

"This book examines, through a multi-disciplinary lens, the possibilities offered by relationships and family forms that challenge the nuclear family ideal, and some of the arguments that recommend or disqualify these as legitimate units in our societies. That children should be conceived naturally, born to and raised by their two young, heterosexual, married to each other, genetic parents; that this relationship between parents is also the ideal relationship between romantic or sexual partners; and that romance and sexual intimacy ought to be at the core of our closest personal relationships - all these elements converge towards the ideal of the nuclear family. Abstract

"Reproduction, Ethics, and the Law" addresses some of the most pressing moral and legal quandaries in contemporary society - those revolving around human reproduction. Technology can both limit and assist childbearing. Courts have assigned legal parenthood to genetic parents of children carried to term by women genetically unrelated to them, and courts have also passed over genetic progenitors to assign parenthood to individuals socially related to children. With developments in medical and surgical interventions for foetus', we have also seen court cases holding women responsible for causing prenatal harm, as well as a landmark Supreme Court decision that might well release industry from liability for causing prenatal harm in the workplace. Scientists are able to use tissue from aborted fetuses to substantially alter the quality of life for persons afflicted with progressive, debilitating disease, and they are now able to fertilize and implant in women's wombs eggs harvested from aborted female fetuses. Physicians are able to sustain infants with no hope for characteristically human lives long enough to make their organs available to other infants in vital need; and they are able to perform prenatal diagnoses that encourage elective abortion. This collection of essays adds to the feminist dimension of the public discussion of how these issues should be addressed. The contributors broaden the discussion considerably in focusing on issues beyond abortion and reproductive technologies, bringing together such themes as surrogacy, adoption, and infertility; frozen embryos and fathers rights; RU 486; foetal harm; and industrial health hazards for women. This volume brings together feminist social and philosophical theory with a practical awareness of concrete social problems and an understanding of new technologies. The contributors are Barbara J. Abstract

Advances in reproductive and perinatal medicine have given rise to difficult ethical issues. Do all women have the right to choose whether to reproduce? What is the moral status of the foetus during various stages of gestation and what obligations do parents have to the foetus during this period? In this book Carson Strong develops an ethical framework that aims to help resolve these and many other issues of concern to health professionals, policymakers and the general public. Strong begins by exploring the significance of reproductive freedom, drawing on constitutional law and feminist writings, among other sources. Next he assesses the moral status of offspring during pre-embryonic, embryonic, foetal and postnatal stages of development, discussing the obligations of procreators during gestation, and offering a perspective on the idea that the moral standing of the foetus increases as foetal development proceeds. He then suggests an approach to the question of how priorities should be assigned to conflicting values, one that draws on a version of casuistic reasoning.In the second half of the book, Strong applies this ethical framework to some of the problematic areas in reproductive and perinatal medicine. These include prenatal genetic testing for susceptibilities to common diseases and for "enhancement" of offspring; research using pre-embryos and embryos; non-traditional family arrangements, such as surrogate motherhood and ovum donation for older women; and treatment of foetuses with anomalies. His discussion takes into account the clinical dimensions of issues and reflects a consideration of the ethical, legal, medical and psychosocial literature. Drawing on the law and feminist writings, this text explores the significance of reproductive freedom. It assesses the moral status of offspring in pre-embryonic, embryonic, foetal and postnatal development and applies an ethical framework to problematic areas in reproductive medicine.

Abstract

In december 2020 moest de faculteit Rechten van de Universiteit Hasselt, veel te vroeg, afscheid nemen van prof. dr. Nan Torfs. Het voorbije jaar kreeg de idee van een boek waarmee de faculteit haar in dankbaarheid zou gedenken concreet vorm. Vele collega's en vrienden waren graag bereid om een bijdrage te schrijven voor het Huldeboek dat nu voorligt. Zij behandelen in hun teksten onderwerpen die nauw aansluiten bij het wetenschappelijk onderzoek van Nan Torfs. De subtitel voor deze publicatie luidt dan ook 'Perspectieven op familie en vermogen'. De bijdragen werden gegroepeerd binnen volgende thema's: het statuut van pensioenen en levensverzekeringen in het familievermogensrecht; het statuut van werk in gezins- en familieverband in het familievermogensrecht; raakvlakken tussen familievermogensrecht en ondernemingsrecht; alimentatierecht vanuit genderperspectief; huwelijkscontracten, samenlevingscontracten en testamenten in de notariële praktijk.
