Abstract

Now in a third, revised edition, Excessive Maritime Claims by J. Ashley Roach and Robert W. Smith is designed for law of the sea and maritime law specialists. The book draws on published governmental material in the public domain, specifically the U.S., and addresses recent progress in maritime security, proliferation of weapons of mass destruction by sea, piracy, and protection of underwater cultural heritage. As a result of significant developments in the law of the sea, primarily with reference to the 1982 Law of the Sea Convention, Excessive Maritime Claims provides up to date coverage of current affairs as well as introduce new topics such as: submarine cables, polar areas, environmental protection, sovereign immunity and sunken ships, and maritime law enforcement.

Abstract

The European Union and the Arctic brings together academics from a range of disciplines to discuss the EU's potential roles in shaping Arctic governance. The book is divided into three parts. The first part examines the EU’s current Arctic policy framework. The second part focuses on the EU’s engagement with Arctic governance at the regional level and encompasses the EU’s engagement with the so-called Arctic Five (five coastal States of the Arctic Ocean), providing examples of some of those relationships. The third part takes a sectoral approach, analysing the EU’s potential contribution to regulation of key human activities in the Arctic, including shipping, fisheries, oil and gas operations, and marine mammals.

Abstract

Under a Memorandum of Understanding between Indonesia and Australia, traditional Indonesian fishermen are permitted access to fish in a designated area inside the 200 nautical mile Australian Fishing Zone (AFZ). However, crew and vessels are regularly apprehended for illegal fishing activity outside the permitted areas and, after prosecution in Australian courts, their boats and equipment are destroyed and the fishermen repatriated to Indonesia. This is an ethnographic study of one group of Indonesian maritime people who operate in the AFZ. It concerns Bajo people who originate from villages in the Tukang Besi Islands, Southeast Sulawesi. It explores the social, cultural, economic and historic conditions which underpin Bajo sailing and fishing voyages in the AFZ. It also examines issues concerning Australian maritime expansion and Australian government policies, treatment and understanding of Bajo fishing. The study considers the concept of “traditional” fishing regulating access to the MOU area based on use of unchanging technology, and consequences arising from adherence to such a view of “traditional”; the effect of Australian maritime expansion on Bajo fishing activity; the effectiveness of policy in providing for fishing rights and stopping illegal activity, and why Bajo continue to fish in the AFZ despite a range of ongoing restrictions on their activity

Abstract

"Japan is quintessentially by geography a maritime country. Maritime surveillance capabilities - underwater, shore-based and airborne - are critical to its national defence posture. This book describes and assesses these capabilities, with particular respect to the underwater segment, about which there is little strategic analysis in publicly available literature. Since the end of the Cold War, Chinese oceanographic and navy vessels have intruded into Japanese waters with increasing frequency, not counting their activities in disputed waters such as around the Senkaku (Diaoyu) Islands and Okinotorishima where China and Japan have overlapping territorial claims. These intrusions have increasingly involved warships, including submarines, sometimes acting quite aggressively. Japan maintains an extraordinary network of undersea hydrophone arrays, connected to shore-stations which are typically equipped with electronic intelligence (ELINT) systems, for monitoring, identifying and tracking submarine and surface traffic in its internal straits and surrounding seas. Some parts of this network are operated jointly with, and are of crucial importance to, the US Navy. Japan's superlative submarine detection capabilities would be of decisive advantage in any submarine engagement. But the relevant facilities are relatively vulnerable, which makes them very lucrative targets in any conflict. This introduces compelling escalatory dynamics, including the involvement of US forces and possible employment of nuclear options"--Publisher's website.
