Abstract

"Large-scale adverse health and developmental outcomes related to tobacco affect millions of people across the world, raising serious questions from a human rights perspective. In response to this crisis, this timely book provides a comprehensive analysis of the promotion and enforcement of human rights protection in tobacco control law and policy at international, regional, and domestic levels. This thought-provoking book offers significant new insights to the topic, laying the foundations for a human rights based approach to tobacco control. Addressing the function of law as a tool to help combat one of the major public health challenges facing society, contributions by global scholars rebut human rights claims presented by the tobacco industry. Emphasis is instead placed upon the human rights of vulnerable individuals, children in particular, as a result of smoking and exposure to second-hand smoke. Illustrating ways in which the right to health can be advanced with regards to tobacco control, smoking and the use of e-cigarettes, this important book will be a vital resource for human rights and health law scholars and practitioners as well as policy makers in public health law"--

Abstract

"Singer's theory of rights, an impressive development of social accounts by pragmatists George Herbert Mead and John Dewey, was developed in Operative Rights (1993). This successor volume includes applications, lectures, replies to critics, and clarifications. For Singer, Dewey, and Mead, rights exist only if they are embedded in the operative practices of a community. People have a right in a community if their claim is acknowledged, and if they would acknowledge similar claims by others. Singer's account contrasts with theories of natural rights, which state that humans have rights by virtue of being human. Singer's account also differs from Kantian attempts to derive rights from the necessary conditions of rationality. While denying that rights exist independently of a community's practices, Singer maintains that rights to personal autonomy and authority ought to exist in all communities. Group rights, an anathema among individualistic theories, are from Singer's pragmatist perspective a valuable institution. Singer's discussion of rights appropriate for minority communities (e.g., the Bosnian Muslims and the Canadian Quebecois) is particularly illuminating. Her book is a model of careful reasoning. General libraries, and certainly academic libraries, should have Singer's Operative Rights. The volume under review is a good addition for research libraries and recommended for graduate students and above."[Singer] examines the views of Rousseau, Mill, and T. H. Green on human rights and those of Dewey and G. H. Mead on the relationship between rights and the democratic process...Recommended."--Choice

Abstract

The concept of dignity is essential to discourses of human rights, and to understand what dignity means and requires, we must address a number of difficult questions with input from a wide range of disciplines. How is human dignity protected, maintained, or ensured in a rapidly changing world? What are the rights and responsibilities that go hand in hand with the concept of dignity? Which beliefs, discourses, individuals, and institutions threaten its global application or block its reach across all categories of difference? How is a consciousness of the importance of dignity developing across the globe? This timely collection brings together a diverse array of field-leading contributors in order to give urgent and sustained attention to such questions and to offer interdisciplinary explorations into this most fundamental of concepts. Contributors from a diversity of academic and cultural backgrounds identify the challenges and opportunities in the realms of research, policy, education, religion, international law, social discourse, and media to define, broaden, and protect human dignity within both public and private spheres. They also address the need for reconstituting the current discourses on dignity to align them more effectively with the intellectual, moral, emotional, and spiritual capacities and concerns that animate the lives of human beings, ultimately gesturing towards a framework for ensuring that each member of the human race will be able to enjoy the conditions that are required if each person is to have the opportunity to realize their full human potential. For its rigorous interdisciplinary inquiry into this deceptively simple concept and for its practical implications for those pursuing real-world solutions, Interdisciplinary Perspectives on Human Dignity and Human Rights is essential reading for researchers and students working within international relations, legal and global studies, philosophy, peace and conflict studies, and human rights and humanitarian law.

Abstract

This book critically investigates Nordic criminal justice as a global role model. Not taking this role for granted, the chapters of the book analyse how Nordic approaches to criminal justice were folded into global contexts, and how patterns of promotion were built around perceptions that these approaches also had a particular value for other criminal justice systems. Specific actors, both internal and external to the region itself, have branded Nordic criminal justice as a form of 'penal exceptionalism' associated with human rights, universalistic welfare and social cohesion. The book shows how building and using the brand of Nordic criminal justice allowed stakeholders to champion specific forms of crime control across a variety of criminal justice areas in both domestic and international settings. The book will be of interest to scholars and students of criminal justice, international law and justice, Nordic and Scandinavian studies, and more widely to the social sciences and humanities.

Abstract

The Moralist International analyzes the role of the Russian Orthodox Church and the Russian state in the global culture wars over gender and reproductive rights and religious freedom. It shows how the Russian Orthodox Church in the past thirty years first acquired knowledge about the dynamics, issues, and strategies of Right- Wing Christian groups; how the Moscow Patriarchate has shaped its traditionalist agenda accordingly; and how the close alliance between church and state has turned Russia into a norm entrepreneur for international moral conservativism. Including detailed case studies of the World Congress of Families, anti-abortion activism, and the global homeschooling movement, the book identifies the key factors, causes, and actors of this process. Kristina Stoeckl and Dmitry Uzlaner then develop the concept of conservative aggiornamento to describe Russian traditionalism as the result of conservative religious modernization and the globalization of Christian social conservatism. The Moralist International continues a line of research on the globalization of the culture wars that challenges the widespread perception that it is only progressive actors who use the international human rights regime to achieve their goals by demonstrating that conservative actors do the same. The book offers a new, original perspective that firmly embeds the conservative turn of post-Soviet Russia in the transnational dynamics of the global culture wars. The Moralist International is available from the publisher on an open-access basis.

Abstract

Why and how can records serve as evidence of human rights violations, in particular crimes against humanity, and help the fight against impunity? Archives and Human Rights shows the close relationship between archives and human rights and discusses the emergence, at the international level, of the principles of the right to truth, justice and reparation.Through a historical overview and topical case studies from different regions of the world the book discusses how records can concretely support these principles. The current examples also demonstrate how the perception of the role of the archivist has undergone a metamorphosis in recent decades, towards the idea that archivists can and must play an active role in defending basic human rights, first and foremost by enabling access to documentation on human rights violations.Confronting painful memories of the past is a way to make the ghosts disappear and begin building a brighter, more serene future. The establishment of international justice mechanisms and the creation of truth commissions are important elements of this process. The healing begins with the acknowledgment that painful chapters are essential parts of history; archives then play a crucial role by providing evidence. This book is both a tool and an inspiration to use archives in defence of human rights.
