Long description: Sind Offene Immobilienfonds noch zukunftsfähig? Die Branche hat eine turbulente Zeit hinter sich. Nachdem sich das Produkt über fast fünf Jahrzehnte erfolgreich am Investmentmarkt behauptet hat, befinden sich aktuell diverse Fonds in der Phase der Aussetzung der Anteilsrücknahme bzw. bereits in der Abwicklung. Als externer Auslöser kann dafür die Immobilien- und Finanzmarktkrise identifiziert werden. Nach Auffassung des Gesetzgebers liegen die Probleme jedoch Produktintern, weshalb im Frühjahr 2010 die Novellierung des Investmentgesetzes zur Neuordnung der Offenen Immobilienfonds angestoßen wurde. Die vorliegende Arbeit analysiert zunächst die Produkteigenschaften auf Basis der aktuellen Gesetzgebung und anschließend den gesamten Gesetzgebungsprozesses vom Diskussionsentwurf 2010 bis zum Gesetzesbeschluss 2011. Es ist eine große Herausforderung, das Vertrauen der Zielgruppe in das Produkt wieder herzustellen. Die gesetzlichen Neuerungen können dafür jedoch das passende Fundament für die Zukunft darstellen.
