Uno de los rasgos más notables del sistema político mexicano ha sido el predominio del poder ejecutivo no sólo sobre el legislativo sino también sobre las demás instituciones y prácticas políticas del país. Con frecuencia se ha señalado que ese predominio presidencial había relegado deliberadamente al Congreso a un segundo plano, restándole atribuciones y sometiéndolo a su voluntad. Tal interpretación del funcionamiento de la división de poderes en el sistema político mexicano rara vez fue cuestionado porque la pasividad del poder legislativo era, en muchos aspectos, más que evidente. Sin embargo, conforme el país ha experimentado cambios políticos y los partidos de oposición han obtenido una mayor presencia e influencia en las dos cámaras, el poder legislativo ha tenido también una mayor participación e importancia en la política nacional. El presente libro recoge ensayos que demuestran plenamente que el Congreso, aun cuando estuviera subordinado al ejecutivo federal, fue una institución que influyó en el sistema político.

This book advances a new reading of the central works of Carl Schmitt and, in so doing, rethinks the primary concepts of constitutional theory. In this book, Jacques de Ville engages in a close analysis of a number of Schmitt’s texts, including Dictatorship (1921), The Concept of the Political (1927), Constitutional Theory (1928), Land and Sea (1942), Ex Captivitate Salus (1950), The Nomos of the Earth (1950) and The Theory of the Partisan (1963). This engagement takes place from the perspective of constitutional theory and focuses specifically on concepts or themes such as sovereignty, the state, the political, constituent power, democracy, representation, the constitution and human rights. The book seeks to rethink the structure of these concepts in line with Derrida’s analysis of Schmitt’s texts on the concept of the political in Politics of Friendship (1993). This happens by way of an analysis of Derrida’s engagement with Freud and other psychoanalysts. Although the main focus in the book is on Schmitt’s texts, it further examines two texts of Derrida (Khōra (1993) and Fors: The Anglish Words of Nicholas Abraham and Maria Torok (1976)), by reading these alongside Schmitt’s own reflections on the positive concept of the constitution.

Doing Business 2007 focuses on reforms, identifies top reformers in business regulation, and best practices in how to reform. This volume is the fourth in a series of annual reports investigating global regulations that enhance business activity and those that constrain it. Co-sponsored by the World Bank and the International Finance Corporation - the private sector arm of the World Bank Group - this year's report measures quantitative indicators on business regulations and their enforcement compared across 175 countries - from Afghanistan to Zimbabwe - and over time. Doing Business 2007 updates indicators developed in the three preceding reports. The ten indicators are: starting a business, dealing with licenses, hiring and firing, registering property, getting credit, protecting investors, trading across borders, paying taxes, enforcing contracts, and closing a business. The indicators are used to analyze economic and social outcomes, such as informality, corruption, unemployment, and poverty. This annually published report gives policymakers the ability to measure regulatory performance in comparison to other countries, learn from best practices globally, and prioritize reforms. This year's report covers 20 additional countries.

Many efforts have been undertaken to address dysfunctional security sector governance in West Africa. However, security sector reform (SSR) has fallen short of radical – transformational – change to the fundamental structures of power and governance in the region. Looking more closely at specific examples of SSR in six West African countries, Learning from West African Experiences in Security Sector Governance explores both progress and reversals in efforts by national stakeholders and their international partners to positively influence security sector governance dynamics. Which branch of government should be entrusted with safeguarding individual rights? Conventional wisdom assigns this responsibility to the courts, on the grounds that liberty can only be protected through judicial interpretation of bills of rights. In fact it is difficult for many people even to conceive of any other way that rights might be protected. John Dinan challenges this understanding by tracing and evaluating the different methods that have been used to protect rights in the United States from the founding until the present era.By examining legislative statutes, judicial decisions, convention proceedings, and popular initiatives in four representative states—Massachusetts, Virginia, Michigan, and Oregon—Dinan shows that rights have been secured in the American polity in three principal ways. Throughout the eighteenth and nineteenth centuries, rights were protected primarily through representative institutions. Then in the early twentieth century, citizens began to turn to direct democratic institutions to secure their rights. It was not until the midtwentieth century that judges came to be seen as the chief protectors of liberties.By analyzing the relative ability of legislators, citizens, and judges to serve as guardians of rights, Dinan's study demonstrates that each is capable of securing certain rights in certain situations. Elected representatives are generally capable of protecting most rights, but popular initiatives provide an effective mechanism for securing rights in the face of legislative intransigence, and judicial decisions offer a superior means of protecting liberties in crisis times. Accordingly, rather than viewing rights protection as the peculiar province of any single institution, this task ought to be considered the proper responsibility of all these institutions.By undertaking a comparison of these institutional methods across such a wide expanse of time, Keeping the People's Liberties makes a highly original contribution to the literature on rights protection and provides a new perspective on debates about the contemporary role of representative, populist, and judicial institutions.
