L'OHADA, entendu « Organisation pour l'Harmonisation en Afrique du Droit des Affaires », après plus de deux décennies de son expérimentation, mérite de marquer une pause et de procéder à une récapitulation de l'application de ses valeurs normatives aux différents domaines relevant du champ matériel d'application du Traité portant le même nom. L'intérêt et l'utilité d'un tel devoir de bilan passent, entre autre, par l'impérieuse relecture de sa loi de l'arbitrage qu'est « l'Acte Uniforme OHADA relatif à l'Arbitrage » (AUA).Un tel exercice de comptabilité doit pouvoir se faire non pas au regard de ce qui a déjà été surabondamment dit, analysé et relayé à son sujet, mais s'impose plutôt la perspective de ce qui reste exceptionnels et inédits. Or, c'est pertinemment sur ces inédits qu'il s'impose la constatation d'une absence de son analyse comparée au plan du droit international, l'un des maillons manquants des différentes approches ayant abordé son examen. Et c'est très exactement à cet exercice intellectuel que s'est livrée l'étude de la problématique que l'auteur de cet ouvrage a jugée bon de mener. Cette démarche lui a permis de contextualiser l'approche tout en mettant en avant-scène la relecture de l'AUA à l'aune des standards transnationaux de la justice arbitrale et au travers du spectre des autres normes juridiques sur l'arbitrage international, qu'elles soient d'origine étatique ou conventionnelle, mais aussi via le prisme de la pratique internationale de la discipline.
