At a time when many around the world are fleeing their homes, seeking refugee protection has become a game of chance. Partly to blame is the law that governs how refugee status decision-makers resolve their doubts. This long-neglected branch of refugee law has been growing in the dark, with little guidance from the Refugee Convention and little attention from scholars. By looking closely at the Canadian jurisprudence, Hilary Evans Cameron provides the first full account of what this law is trying to accomplish in a refugee hearing. She demonstrates how a hole in the law's normative foundations is contributing to the dysfunction of one of the world's most respected refugee determination systems, and may well be undermining refugee protection across the globe. The author uses her findings to propose a new legal model of refugee status decision-making.

Abstract

Based on a systematic and empirical comparative study of six European Union countries, Christel Querton explores judicial decision-making in the context of persons fleeing armed conflicts in the EU. Addressing and redressing misconceptions about the relevance of the Refugee Convention, this book demonstrates how appellate authorities across the EU approach situations of armed conflict predominantly through outdated understandings of warfare and territoriality. Thus, they apply a higher standard of proof than is warranted by international refugee law. Adopting a gender perspective, Querton also shows how appellate authorities fail to acknowledge the gender-differentiated impact of armed conflicts. Drawing from gender and security studies, this book proposes an original conceptual framework which, supported by existing international legal standards, reframes the definition of 'refugee' and better reflects the reality of violence in modern-day conflicts. In doing so, it re-asserts the Refugee Convention as the cornerstone of international protection.

Spatial justice is about equitable access to parks, housing, and more. During societal emergencies, including pandemics and climate change, the relationship between people and places requires greater attention and action to integrate the knowledge of people with lived experience, especially historically marginalized communities. On September 20 and 21, 2021, the National Academies Roundtable on Population Health Improvement hosted a virtual workshop to explore the nature, use, design of, threats, and changes to places as a resource for health and public spaces as a shared resource. This Proceedings document summarizes workshop discussions.

Esta obra trata de presentar de forma sistematizada, recurriendo a un criterio cronológico, las principales etapas históricas por las que ha transitado la categoría sociojurídica Infancia a lo largo del devenir de los tiempos, para facilitar con ello un acercamiento paulatino a la moderna noción que tal concepto ha ido adquiriendo en los actuales sistemas normativos, tras la aprobación y ulterior entrada en vigor de la "Convención sobre los Derechos del Niño". Efectivamente, la moderna configuración de la persona menor de edad como ciudadano de presente, verdadero agente activo del tráfico jurídico, partícipe directo de la realidad social y las relaciones que le envuelven, y no una mera entelequia o proyecto de futuro del adulto que podrá ser, ha dejado atrás decenas de siglos en los que la niñez no era digna, ni tan siquiera, de ser tomada en consideración.
