The first edition of The American Convention on Human Rights showed the hesitant steps of a court trying to find its way in a region plagued by egregious human rights violations, the absence of democracy and a significant disregard of international human rights norms. The second edition followed this up by introducing an analysis of the advancement in the reasoning of the Court regarding the violations that it had been dealing with since its inception.
This third edition contains an updated and in-depth analysis of the norms applied by the Inter-American Court of Human Rights to deal with the most frequent human rights violations that still occur in Latin America regarding life, humane treatment, personal liberty, due process, access to justice, the principle of legality and judicial protection. The second edition contained a chapter on disappearances, as the Court at the time had significantly developed its reasoning on the matter; this third edition shows the latest evolution on the subject, which still plagues the region. In addition, a new chapter examines discrimination, an issue that has emerged as a frequent and important concern in the Court's work.
This edition also reflects the dynamic development of the Court's work in recent years, which has evolved to a more refined jurisprudence covering more specific aspects of the rights examined and topics not previously addressed.

L'ouvrage de Bertha Santoscoy donne une image très complète de l'organe principal du système interaméricain des droits de l'homme : La Commission interaméricaine des droits de l'homme. Il en analyse son évolution au cours des années et souligne son caractère original, ses fonctions multiples et l'impact de son activité sur les réalités politiques du Continent américain. L'auteur attache ici une grande importance à la question de la double compétence de la Commission, qui permet la coexistence de deux systèmes : celui de la Déclaration américaine des droits et devoirs de l'homme; et celui de la Convention américaine relative aux droits de l'homme. Ce cumul des fonctions fait de la Commission un organe sui generis, sans parallèle, qui assure à la conception des droits de l'homme une unité aussi bien politique que juridique. Mais pour l'essentiel, l'ouvrage consiste en un examen approfondi du système des pétitions individuelles. La familiarité de l'auteur avec la procédure de la Commission confère à cette étude un intérêt tout particulier, car elle s'y attache à démontrer comment, par le biais du traitement des pétitions individuelles, et particulièrement en évitant de se prononcer d'entrée de cause sur la recevabilité, la Commission a su étendre sa compétence aussi bien du point de vue personnel que materiel. En el presente texto se analizan problemas, soluciones y representaciones en torno a los derechos humanos, fruto de investigaciones terminadas. Con relación a los problemas, el capítulo I estudia la concepción individualista de los derechos humanos que dificulta su implementación efectiva, mientras el capítulo II reflexiona acerca del comportamiento del Estado colombiano ante el Sistema Interamericano de Derechos Humanos que impacta negativamente en la garantía de los derechos de las víctimas. Respecto a las soluciones, varios capítulos se ocupan de algunas políticas públicas destinadas a la población víctima del conflicto armado y el desplazamiento forzado interno. Tal es el caso de los capítulos VII y VIII los cuales analizan, respectivamente, las estrategias de intervención psicosocial dirigidas a la promoción y fortalecimiento de la salud mental en población víctima de violencia sociopolítica y las acciones que el Estado colombiano ha desarrollado con el propósito de garantizar los derechos de las personas con discapacidad en el contexto de guerra interna.
