Abstract

The US and English models for financial restructurings of companies in financial difficulties are fundamentally different. The first edition of this work was written in the wave of restructurings precipitated by the credit crisis which brought into the spotlight arguments that the principles behind the US chapter 11 regime ought to be imported into a UK statutory scheme. Since then, the American Bankruptcy Institute Commission to Study Reform of Chapter 11 has reported, and the European Commission has issued a recommendation on a new approach to business failure and insolvency. Creditors increasingly have security over the debtor's assets in the US, whilst the very nature of the finance market is changing in the UK. Across much of Europe reform of restructuring procedures is underway or under consideration. This edition is written against a backdrop of reflection and revision.

Abstract

This paper presents the variety of debt relief measures from which Mali has benefited in recent years. Particular emphasis is placed on the 1988 measures accorded by the Paris Club under the Toronto terms, of which the country was the first beneficiary. This relief, and the adjustment policy which Mali formed with it, were relatively successful. Indeed, they led to a cleansing of public finances marked, before the political events of Spring 1991, by the total removal of both domestic and international arrears. The size of the improvement in the situation thus obtained, however, was reduced by the existence of debts with Paris Club members excluded from the Toronto terms and above all by heavy debts with non-Paris Club members (the ex-USSR, China and Arab countries). Debt held by multilateral institutions which was not eligible for rescheduling also represented a large financial burden. As a result, in a short time.

Abstract

Ce document présente les différentes mesures d'allégement de la dette dont le Niger a bénéficié depuis 1983. Possédant une dette importante à l'égard des banques commerciales, du fait du développement de l'exploitation de l'uranium, le Niger a eu recours à la fois au Club de Paris et au Club de Londres pour rééchelonner régulièrement sa dette publique. Hormis ces procédures traditionnelles, le Niger a été le premier pays à bénéficier du Fonds de désendettement de l'IDA pour racheter sa dette bancaire avec décote grâce à des dons. Malgré l'allégement issu de cette opération et celui résultant de l'application des termes de Toronto par le Club de Paris, qui en 1991 représentaient l'allégement de la dette maximal auquel le Niger pouvait prétendre par les procédures usuelles, le gouvernement nigérien ne peut s'acquitter de ses obligations. La politique d'ajustement entreprise et en particulier la tentative d'assainissement des finances publiques, n'ont pas permis de rétablir l'équilibre.

In an era when many of us depend on debt to survive but struggle with its consequences, Financing Prosperity by Dealing with Debt draws together current thinking on how to solve debt crises and promote inclusive prosperity. By profiling existing action by credit unions and community organisations, alongside bold proposals for the future, with contributions from artists, activists and academics, the book shows how we can rethink the validity and inevitability of many contemporary forms of debt through organising debt audits, promoting debt cancellation and expanding member-owned co-operatives. Abstract

What does the Paris Club do for debtor countries, and more particularly for the poorest of them? Set up to ease the liquidity constraints of a country experiencing payment problems, by rescheduling its debt with the creditor governments, the Paris Club has frequently had to intervene since the beginning of the debt crisis. Since the Toronto Summit of June 1988 it has also been playing the role of aid provider for the poorest debtor countries. After describing the functioning of the Paris Club in part one, the study goes on to evaluate the extent and role of the liquidity provided by the Club throughout the 1980s in part two. An initial finding is that the sums rescheduled through its action were very much greater than those lent over the same period by the creditor governments comprising the Club. Through focusing on selected African countries, the paper then shows that the main role of the liquidity created has been to avoid these countries' accumulating massive arrears and being cut.

In addition, it provides data on net resource flows to major country groups.These data are reported to the OECD by the governments and credit institutions of its Member countries, and the main international organisations. Common reporting rules allow for a comprehensive and consistent account of external debt. This publication is therefore invaluable for international comparisons and country risk analysis.
