To put the ARTS & ECONOMICS next to each other, as in the title to this book, may be shocking to some readers. Must not creative art be free of economic constraints, must it not lead a life of its own? And is economics not the realm of mean commercial dealings? This book argues that it is not so: the ARTS & ECONOMICS go well together, indeed need each other. Without a sound economic base, art cannot exist, and without creativity the economy cannot flourish. There is a second way in which the Arts and Economics go together, namely in the sense of applying economic thinking to the arts. Over the last decades, this scholarly endeavor has been established under the name of "The Economics of Art" or "Cultural Economics". But this may also sound revolting to some readers as it suggests an imperialistic extension of a lowly benefit-cost calculus to the world of art. This fear is unwarranted. On the contrary, cultural economists stress the social value of art and defend it against a crude business view of art. Rather than dismissing art without direct commercial profit, art economists seek ways and means of supporting it. This book is not a textbook summarizing the achievements attained by the economics of art. Such books already exist, among them the author's own, Muses and Markets, Explorations in the Economics of Art, written jointly with Werner Pommerehne. Ce manuel est destiné aux acteurs du marché de l'art qui n'auraient pratiquement pas de connaissances juridiques. Il aborde les questions légales qui se posent tout au long du parcours d'une œuvre d'art, de sa création à son éventuelle disparition. Par sa structure, cet ouvrage aborde le droit de l'art d'une manière innovante et atypique. Il est conçu selon une logique particulière : les chapitres sont structurés selon les étapes parcourues par l'œuvre d'art au cours du temps. C'est pourquoi il s'ouvre sur le statut de l'artiste, avant que soient abordées les questions liées aux droits de l'auteur, aux contrats entre artistes et galeries, puis à la vente et à la revente de l'œuvre, jusqu'à son hypothétique destruction. Il s'agit ici d'appliquer les questions juridiques à la réalité particulière du marché de l'art et à ses différents acteurs (artistes, collectionneurs, marchands, galeries, musées...), à ses différents marchés (marché primaire, marché secondaire et secteur culturel), ainsi qu'aux aspects liés à la fiscalité et aux droits de succession. Or, pratiquement rien, en Belgique, ne se rapproche d'un « code du droit de l'art ». Ce livre apporte les réponses spécifiques que les acteurs attendent.

Bereits das 19. Jahrhundert kannte das Phänomen der finanziellen Spekulation mit Kunst und kritisierte daher die Orte des Kunstmarkts in teilweise scharfen Tönen. So nannten Kunstkritiker das Auktionshaus verächtlich ein Casino oder eine Börse der Kunst. Lukas Fuchsgruber führt hinter die Kulissen des Spektakels der Auktion und zeigt die Bedeutung von Versteigerungen für die damalige Pariser Kunstwelt. Die Studie geht Schritt für Schritt vor, von den ökonomischen und rechtlichen Besonderheiten des Auktionswesens in Frankreich, über den erfolgreichen Schritt der Pariser Auktionatoren mit dem Hôtel Drouot im Jahr 1852 ein gemeinsames großes Auktionshaus zu errichten, bis hin zum Verhältnis dieses Orts zu Kunsthändlern und Künstlern und seiner Diskussion in der Kunstkritik. Anhand von Archivquellen, historischer Literatur und zahlreichen Illustrationen wird so durch die Räume des Auktionshauses geführt, und durch eine Schlüsselzeit der Entwicklung des Auktionsmarkts. Diese interdisziplinäre Recherche richtet sich an alle, die sich für den Kunstmarkt, französische Kunstgeschichte oder die urbane Geschichte von Paris interessieren. Vor allem will sie aber ein Beitrag zu einem neuen Blick auf die Kunstgeschichte des 19. Jahrhunderts sein, durch den Fokus auf das Auktionshaus als einen der zentralen Orte an dem Kunst zu sehen war, neben Salon, Museum und Galerien. « La bourse de l’art », le « casino » : c’est ainsi que les critiques d’art du XIXe siècle désignent l’hôtel Drouot. À partir de 1852, les commissaires-priseurs centralisent leurs ventes aux enchères en ce lieu, métamorphosant par là le marché de l’art français en profondeur. In an increasingly globalised world, economic and cultural imperatives can be seen as two of the most powerful forces shaping human behaviour. This book considers the relationship between economics and culture both as areas of intellectual discourse, and as systems of societal organisation. Adopting a broad definition of culture, it explores the economic dimensions of culture, and the cultural context of economics. The book is built on a foundation of value theory, developing the twin notions of economic and cultural value as underlying principles for integrating the two fields. Ideas of cultural capital and sustainability are discussed, especially as means of analysing the particular problems of cultural heritage, drawing parallels with the treatment of natural capital in ecological economics. The book goes on to discuss the economics of creativity in the production of cultural goods and services; culture in economic development; the cultural industries; and cultural policy.
