A l’ère du « tout Internet », les acquis du droit de la consommation sont menacés tant dans le champ contractuel que dans le domaine des pratiques du commerce. Même la protection de certains droits fondamentaux n’échappe pas à l’évolution qui s’impose aux utilisateurs des T.I.C. (Technologies de l'Information et des Communications). Nombreux sont les juristes confrontés à ces nouvelles préoccupations dans leur pratique quotidienne. L'ouvrage aborde principalement les questions relatives à : - la publicité, les autres pratiques commerciales et la vente sur Internet, en ce compris les modes de paiements électroniques et les ventes aux enchères ; - les clauses abusives dans les contrats de téléphonie mobile et dans quelques contrats-types de fournitures d’énergie ; - la protection des données personnelles des utilisateurs d’Internet. L'encadrement légal et déontologique des technologies de l'information et de la communication L’usage des technologies de l’information et de la communication (T.I.C.) s’est fortement étendu ces dernières années. Alors que de plus en plus de juristes utilisent ces formidables outils, il paraissait opportun de faire le point sur leur encadrement légal et parfois déontologique : - F. Teheux et J.-F. Henrotte rappellent aux avocats les obligations déontologiques et légales sur la communication électronique. Ils traitent ensuite des sites web et réseaux sociaux (Facebook, LinkedIn, Twitter,…) en tant qu’outils de promotion et d’e-services. - V. Lamberts s’intéresse aux logiciels de gestion de connaissances, de cabinets ou d’études qui permettent de retrouver et de réutiliser facilement des actes juridiques qui ont été rédigés dans un dossier particulier par un confrère. Est-ce autorisé ? Le clerc qui met en place une base de données de jurisprudence inédite en est-il titulaire ? - J.-F. Derroitte aborde les logiciels de gestion de cabinets ou de connaissances qui traitent des données à caractère personnel. Quelles sont les obligations légales qui pèsent sur le cabinet ou l’étude ? - J.-Ph. Bruyère et A. Pel s’interrogent sur le contrôle de l’usage des T.I.C. Les réseaux sociaux font resurgir les anciennes peurs des bureaux lors de l’avènement d’Internet : les employés ne perdent ils pas un temps considérable ? Ne violent-ils pas le secret professionnel auquel ils sont astreints en s’épanchant sur Facebook ? La tentation de contrôler l’usage des T.I.C. renaît. Quelles en sont les règles ? - Le droit pénal s’est adapté aux T.I.C. depuis 2000. Les lois sont généralement sanctionnées pénalement. Le cyberjuriste pourrait donc aussi devenir un cyberdélinquant.
