FIFA has accepted the jurisdiction of the CAS as from 11 November 2002. This date does not mark the beginning of the arbitration of the CAS in football matters, however it has to be stated, that from this date on football disputes in front of the CAS increased enormously. This book is dedicated to the most important decisions of the CAS in football disputes. These awards are analyzed by experts, practicing all over the world. Most of the authors have been directly involved in the proceedings before the CAS. The commentaries cover a broad spectrum of disputes, inter alia, disputes concerning the contractual stability, protection of young football players, doping, football hooliganism, match fixing, players release, multiple club ownership, player agents and the stays of execution. A partir de la notion de droit transnational, cet ouvrage s’efforce de décrypter l’autorégulation du mouvement sportif transnational. Il démontre que la lex sportiva est constituée de plusieurs ordres juridiques, ceux des fédérations sportives internationales, qu’un ordre juridique transnational supplémentaire, celui du Comité international olympique, tend à centraliser, aidé en ce sens par l’activité du Tribunal arbitral du sport et de l’Agence mondiale antidopage. L’ouvrage évalue par la suite le degré d’autonomie de la lex sportiva . Emancipée dans une large mesure des droits étatiques et mal encadrée par un ordre juridique international trop decentralisé, la lex sportiva connaît de substantielles limites depuis que le droit communautaire s’en est saisi. Based on the notion of transnational law, this book analyses the self-regulation of the transnational sports movement. It shows that lex sportiva is made of the various legal systems of the international federations, which the legal order of the International Olympic Committee tends to centralise, assisted by the activities of the Court of Arbitration for Sports and of the World Anti-Doping Agency. The book evaluates the degree of autonomy of lex sportiva . Largely liberated from national rules and badly framed by a too decentralised international legal system, lex sportiva is nevertheless substantially limited by European Law.
