In dieser Arbeit wird im Rahmen eines Strukturvergleichs mit anderen gewinnbezogenen Ansprüchen eine Analyse der Besonderheiten des § 10 UWG vorgenommen. Anschließend wird untersucht, inwieweit sich dessen spezifische Anwendungsprobleme de lege ferenda beheben ließen oder wo umgekehrt ein Gewinnabschöpfungsanspruch im UWG von vorneherein nur ganz begrenzte Präventionswirkung entfalten kann, so dass insoweit über alternative Präventionsinstrumentarien nachgedacht werden sollte.

Abstract

National intellectual property (IP) systems can play a pivotal role in fostering innovation and knowledge diffusion. This report analyses Kazakhstan’s IP system with regards to its support of the country’s innovation performance. In particular, it assesses the organisation and governance of Kazakhstan's IP system as well as the needs and challenges faced by different groups of actual and potential IP users – ranging from universities and public research institutions to state-owned enterprises and small businesses. The review provides a comprehensive set of statistics describing the use of IP in Kazakhstan in recent years, identifies the system’s strengths and weaknesses, and presents a range of specific policy recommendations to address existing challenges.

Abstract

Africa is rising: with double-digit growth figures in many countries, its growing middle and upper class, the continent represents an untapped, dynamic, fast-moving and competitive market that businesses can scarcely ignore. Intellectual property right owners are increasingly paying attention to this new African dynamic and have started to invest into African markets. Unfortunately, so have counterfeiters. Taking action against counterfeit and pirated products in Africa is a challenge against which right holders and their representatives often feel overwhelmed. Filling a gap in the market, this is the first book providing a detailed overview of the law and practice in relation to intellectual property rights enforcement in all 54 African countries. For the first time, a comprehensive manual on the conditions and procedures under which the civil and criminal courts, the police and customs take action with regard to counterfeit and pirated goods is available. In order to successfully enforce intellectual property rights in Africa, knowledge of national legislation and procedures, local habits and practices is essential. The book offers a stimulating review of the framework in place for the enforcement of intellectual property rights against pirated and counterfeit goods in all 54 countries and through the two main regional intellectual property organisations, the OAPI and the ARIPO. Abstract

There is a veritable gold rush mentality in the life science world as scientists, entrepreneurs and multinationals are staking claims to the ‘code of life’ embodied in the world’s current stock of plants, animals, microbes and human populations. In response, the communities that see themselves as the custodians of both that traditional knowledge and specific genetic resources have demanded greater recognition of their role in creating and conserving this resource, access to any resulting improvements and a share of the benefits arising from their patrimony. This has precipitated a widespread effort—in local communities, in the marketplace, in many developing and developed countries and at the talks in the Doha Round of the WTO—to reconcile the interests and concerns of the two opposing groups. This edited volume explores the legal, economic and political context for the debate about intellectual property rights for traditional knowledge and genetic resources and critically analyses the theory and practice of access and benefits sharing efforts around the world. The book also investigates the current flashpoints—the David and Goliath battle between Monsanto and Percy Schmeiser over farmers’ rights; the dispute over coexistence of GM and organic production; and the ownership and control of human genetic materials stored in human gene banks around the world. .
