Dans le contexte européen de discipline budgétaire, les autorités publiques recourent de plus en plus aux partenariats public-privé (PPP) pour répondre aux besoins d’investissements dans de nouvelles infrastructures ou dans la mise à niveau des infrastructures existantes mais vieillissantes (autoroutes, prisons, trams, écoles…) tout en limitant le déficit public. Dans la pratique, la mise en place de chaque projet de PPP implique la rédaction d’un cadre contractuel dont la complexité est maîtrisée par des experts financiers, techniques et juridiques qui participent à ce type de projet. Un cadre contractuel est ainsi construit autour de chaque projet de PPP. Ce cadre contractuel tient de plus en plus compte des exigences européennes du SEC 2010 en ce qui concerne la répartition des risques et des avantages entre les partenaires public et privé. Dans cet ouvrage, l’auteur livre une analyse complète du cadre contractuel des PPP au regard du SEC 2010, sous l’angle de la répartition des risques et des avantages entre les partenaires public et privé. Cet ouvrage permet à toutes personnes qui désirent comprendre le cadre contractuel des PPP et les contraintes associées au SEC 2010 d’avoir accès pour la première fois à un ouvrage de référence rédigé en français et présentant, au regard du SEC 2010, les principales normes qui encadrent la répartition des risques et des avantages dans les PPP « hors bilan ».
