Abstract

Maud Coudrais propose, dans cet essai, de renouveler notre regard sur le droit pour lui redonner une chance d’organiser les rapports sociaux de manière moins chaotique. Elle dresse un constat documenté et sans concession du processus avancé de déshumanisation du droit, fondé sur le culte de la raison et la dévalorisation de l’émotion. Les normes s’artificialisent toujours davantage, combattant les lois de la nature et dénaturant la nature des lois. La pensée juridique se nécrose. Les avocats se bureaucratisent. Les juges se robotisent. Une grande partie du peuple est démobilisée et la force publique est livrée à une gestion managériale. En réalité, cette technocratie juridique n’est qu’une dangereuse illusion. Le mépris des affects est une stratégie vouée à l’échec comme les nombreuses manifestations du violent retour de l’émotionnel refoulé le montrent : intégrisme terrorisme, déjudiciarisation perverse, tribunal médiatique, démagogie législative, soulèvements populaires, séparatismes communautaires, ensauvagement sécuritaire, zones de non-droit… Ce livre destiné tant aux juristes qu’aux citoyens nous incite à tirer les leçons de nos expériences collectives en redécouvrant l’irréductible humanité du droit et ses vertus oubliées. Le droit n’est pas seulement un savoir-faire mais avant tout un savoir-être. La santé de l’organisme social repose sur l’indispensable interaction entre intellect et sensibilité. Ne serait-il pas temps d’arrêter d’utiliser le droit comme une technique de domination et de retrouver la voie d’une éthique juridique de l’humilité, de la bonne foi et de la bonne volonté ?

Abstract

This is an open access book. Animals are the traditional blind spot in human rights theory. This book brings together the seemingly disparate discourses of human and animal rights, and looks at emerging animal rights as new human rights. It approaches the question whether animals can and should have human rights through a comprehensive review of contemporary human rights philosophy, discussing both naturalistic and political justifications of human and animal rights. On philosophical as well as practical grounds, this book argues that there are compelling conceptual, principled, and prudential reasons for modernizing the human rights paradigm and integrating animals into its protective mandate. Moreover, this book proposes the novel One Rights approach as a new (post-)human rights paradigm for the Anthropocene. One Rights advances a holistic understanding of the indivisibility and interdependence of human and animal rights. This book explores how the systematic subjugation, exploitation, and extermination of animals simultaneously contributes to some of the gravest social and environmental threats to human rights, such as animalistic dehumanization and climate change. This book submits that, in light of their socio-political and ecological interconnectedness, human and animal rights are best protected in concert. The themes of this book are part of a larger conversation about postanthropocentric legal paradigms emerging in the Anthropocene. For human rights to survive in this era of anthropogenic crises, we need to abandon the toxic ideology of human exceptionalism and embrace a more inclusive version of (post-)human rights that tends to the nonhuman. This book intends to show that a holistic One Rights approach promises to achieve better rights-protective outcomes for humans, animals, and their shared planetary home.

Abstract

This open access book discusses the impact of protracted peace processes on identities in conflict. It is concerned with how lingering peace processes affect, in the long-term, patterns of othering in protracted conflicts, and how this relates with enduring violence. Taking Israel and Palestine as a case study, the book traces different representations of success and failure of the protracted peace process, as well as its associated policies, narratives, norms and practices, to analyze its impact on identity and its contribution to the maintenance and/or transformation of the cultural component of violence. On the one hand, drawing from an interdisciplinary approach comprising International Relations (IR), History and Social Psychology, this book proposes an analytical framework for assessing the specificities of the construction of identities in protracted conflicts. It identifies dehumanization and practices of reconciliation in ongoing conflicts – what is called peace-less reconciliation – as the main elements influencing processes of othering and violence in this kind of conflicts. On the other hand, the book offers an empirical historical analysis on how the protracted peace process has impacted identity building and representations made of the ‘other’ in the case of the Israeli-Palestinian conflict since the end of the 19th century to the present day.

Abstract

This book addresses the debate usually tagged as being about ’markets in human body parts’ which is antagonistically divided into pro-market and anti-market positions. The author provides a set of propositions about how to approach this and shows a way out of the concrete impasse of it. Assumptions about markets and bodies that characterize this debate are analyzed and described while the author argues that these assumptions are in fact constitutive for exchanges of human bodily material – but in unacknowledged ways. It is concluded that what we need is a different analytical approach to better understand the mechanisms at play when organizations exchange organs, tissues and cells for use in transplantation and fertility medicine.
