After a variety of stumbling blocks and false starts, the Treaty of Lisbon is now In force, despite the widespread Instability let loose in the tea two years as protectionism reared its terrified head in many EU Member States and nationalisation and massive state support for the national banking sector became panaseas for the global financial drama. This volume deals with the future of European criminal law under the Lisbon Treaty. The contributions assess the risks and prospects of the progressing European integration with a special focus on the enlarged competences of the EU in the field of criminal law. Das Inkrafttreten des Vertrags von Lissabon hat auch für das europäische Strafrecht erhebliche Änderungen mit sich gebracht: Der Grundsatz der gegenseitigen Anerkennung wurde zum zentralen Strukturprinzip erhoben und die Kompetenzen der EU zur Strafrechtsharmonisierung erheblich erweitert. Zudem soll nach Überwiegender Ansicht die EU nunmehr auch erstmals zur Schaffung echten supranationalen Strafrechts ermächtigt sein. Den Gegenpol zu dieser zunehmenden Supranationalisierung des Strafrechts bildet - zumindest aus deutscher Sicht - die Rechtsprechung das BVerfG, das in seinem Lissabon-Urteil versucht, diesem deutlich erweiterten Handlungsspielraum der EU Grenzen zu ziehen. Der vorliegende Band will Wege aufzeigen, wie dieses Spannungsfeld zwischen Europäisierung und Bewahrung einzelstaatlicher Souveränität in dem besonders sensiblen Bereich des Strafrechts gelöst oder zumindest entschärft werden kann. Ziel muss es sein, die mit der Erweiterung der strafrechtlichen Kompetenzen der EU verbundenen Risiken zu bewältigen und die sich eröffnenden Chancen zu nutzen. Die Beiträge sind überwiegend aus dem IV. Kolloquium des Instituts für Kriminalwissenschaften der Georg-August-Universität Göttingen (2. Juli 2010) hervorgegangen, wurden z.T. aber auch exklusiv für diesen Band erstellt.

"On 1 December 2009 the Treaty of Lisbon entered into force. Although often described as primarily technical, it significantly amended the Treaty on the European Union (TEU) and the old EC Treaty (now the Treaty on the Functioning of the European Union, TFEU). The authors' aim in this book is to explore what the Treaty means for social law and social policy at the European level. The first part of the book on the general framework looks - at a time of financial crisis - for new foundations for Europe's Social market economy, questions the balance between fundamental social rights and economic freedoms, analyses the role of the now binding Charter of Fundamental Rights, maps the potential impact of the horizontal clauses on social policy and addresses the possibilities for social partners to enlarge their role in labour law and industrial relations. The second part, on the social framework of the Treaty, focuses on the development of the Union's competences. A l'origine, ni le traité CE, ni le traité sur l'Union européenne, ne comportaient de catalogue écrit des droits fondamentaux. La garantie des droits fondamentaux est d'abord l'un des acquis du droit communautaire européen. Dès 1974, la Cour de justice des Communautés européennes, - devenue avec le Traité de Lisbonne la Cour de justice de l'Union européenne - a décidé que les droits fondamentaux feraient partie des principes généraux du droit qu'elle se devait de sauvegarder et dont elle s'inspirerait. En 1999, le Conseil européen de Cologne, a décidé d'établir un catalogue de ces droits «afin d'ancrer leur importance exceptionnelle et leur portée de manière plus visible pour les citoyens de l'Union.» Ainsi allait naître la Charte des droits fondamentaux de l'Union européenne, une première fois proclamée à Nice le 7 décembre 2000. Une seule question avait alors été laissée en suspens, celle de la valeur juridique de la Charte. Désormais, c'est une Charte adaptée et re- proclamée le 12 décembre 2007 à laquelle le Traité de Lisbonne donne force obligatoire en reconnaissant aux droits, libertés et principes proclamés dans la Charte des droits fondamentaux la même valeur juridique que les traités. Ainsi, une nouvelle étape est-elle franchie. Elle créé de nouvelles obligations pour le juge dans la nécessité de préserver les droits fondamentaux. Avec la force contraignante de la Charte, ce sont aussi des sources multiples auxquelles s'est référé cet instrument nouveau qui vont devenir, pour le juge européen, comme pour le juge national, l'objet d'applications, d'interprétations ou de sanctions. Et notamment les principes issus de la Convention sur les droits de l'homme et la biomédecine en ce qui concerne le patrimoine génétique, de la Charte sociale européenne et de la Charte révisée du Conseil de l'Europe comme de la Charte communautaire des droits sociaux fondamentaux des travailleurs. La Charte concerne donc l'ensemble des droits de la deuxième ou de la troisième génération et leur incidence sur le domaine de l'environnement comme sur celui de la consommation, sur les droits des handicapés aussi bien que sur les conditions de vie des personnes âgées. Dans le présent ouvrage, issu d'un colloque organisé par l'IDHAE à la Cour de Justice des Communautés européennes, à Luxembourg, le 16 mai 2008, sous la présidence de M. Vassilios SKOURIS, Président de la CJCE, Joël ANDRIANTZIMBAZOVINA, Laurence AZOUX-BACRIE, Thierry BONTINCK, Olivier DUBOS Bertrand FAVREAU, Carine LAURENT-BOUTOT Fabien MARCHADIER Sébastien PLATON Christophe PETTITI, Sophia SPILIOTOPOULOS, envisagent à la lumière tant de son élaboration que de la récente ratification, le nouvel impact de la Charte en Europe après le traité de Lisbonne.

Le 13 décembre 2007, les dirigeants des 27 Etats membres de l’Union européenne se réunissaient à Lisbonne afin de signer le traité modifiant le traité sur l’Union européenne et le traité instituant la Communauté européenne. Ce nouveau texte, aux appellations multiples – mini-traité, traité simplifié, traité réformateur, traité modificatif – est en cours de ratification. Certes, le rejet irlandais du 12 juin 2008 a semblé compromettre, un temps, l'entrée en vigueur du traité. Toutefois, aucun des autres Etats membres ne semblent prêts à renoncer à ce texte et l’idée de convoquer un second référendum a fait son chemin et devrait intervenir le 2 octobre prochain. Surtout, quel que soit son devenir, toute oeuvre de révision présente un intérêt théorique pour l’analyse et la compréhension du droit de l’Union européenne. Sans prétendre faire ici un commentaire article par article du traité de Lisbonne, l’ensemble des contributions propose une analyse fouillée des principales innovations introduites par ce traité en s’efforçant de répondre à une interrogation : ces innovations emportent-elles des reconfigurations nécessaires (et, pour certaines, reprises du projet constitutionnel) de l’Union européenne ou amorcent-elles un processus de déconstitutionnalisation ? Volontairement, l’interrogation est audacieuse, presque ébouriffante. Elle suscite nombre de questions et, en particulier, l’éternelle : peut-on qualifier le processus antérieur de processus de constitutionnalisation ? Si tel est le cas, le traité de Lisbonne prive-t-il le processus de certains de ses attributs constitutionnels ? Le retour à l’intergouvernemental dans le processus d’élaboration est une première indication d’importance, mais sur le fond, qu’en est-il, en particulier si l’on compare à l’existant ? Sans prétendre résoudre l’ensemble de ces questions, l’ouvrage a le mérite, au-delà d’un commentaire technique des modifications enregistrées, d’alimenter la réflexion fondamentale avec toutes les passions que celle-ci peut générer.
