Requirements of international law, European primary law and EU chemicals legislation (REACH and CLP) require a high level of protection for human health and the environment. Nanomaterials pose special challenges to this mandate of protection because their risk management is hampered by structural uncertainty. This piece of work first examines the question of whether chemicals legislation provides sufficient incentives so that manufacturers and importers of nanomaterials ensure the normatively desired high level of protection. The institutional context created by chemicals legislation, together with all its legal, market-related and other impulses, provides the scope of the investigation. The specific incentive situation of the actors who produce or introduce nanomaterials in the EEA constitute is the subject-matter at the center of analysis. Identified impediments and lack of incentives, in a second step, can be used to elaborate design alternatives in order to further develop, in terms of a responsive regulation, the actors' context of action in the direction of the normative objective. Vorgaben des Völkerrechts, des europäischen Primärrechts und des Stoffrechts der Europäischen Union (REACH und CLP) fordern ein hohes Schutzniveau für die menschliche Gesundheit und die Umwelt. Nanomaterialien stellen besondere Herausforderungen an diesen Schutzauftrag, weil deren Risikomanagement durch eine strukturelle Ungewissheit gehemmt ist. Die Arbeit untersucht zunächst die Frage, ob das Stoffrecht hinreichende Anreize setzt, so dass Hersteller und Importeure von Nanomaterialien das normativ angestrebte hohe Schutzniveau sicherstellen. Der durch das Stoffrecht geschaffene institutionelle Kontext mit allen seinen rechtlichen, marktvermittelten und sonstigen Impulsen stellt dabei den Untersuchungsrahmen zur Verfügung; die spezifische Anreizsituation der Akteure, die Nanomaterialien im EWR herstellen oder in diesen einführen, bilden den Betrachtungsgegenstand. Auf der Basis identifizierter Hemmnisse und fehlender Anreize lassen sich sodann in einem zweiten Schritt Gestaltungsalternativen ausarbeiten, um den Handlungskontext der Akteure in Richtung der normativen Zielsetzung sowie i. S. e. responsiven Regulierung weiterzuentwickeln.
