« Dans l’exercice de leurs compétences respectives, l’État fédéral, les communautés et les régions veillent à la protection et au bien-être des animaux en tant qu’êtres sensibles. »L’insertion de cette phrase à l’article 7bis de la Constitution belge tend à modifier considérablement notre rapport législatif aux animaux non humains.En Belgique, en effet, l’adoption d’une telle proposition est aujourd’hui devenue une réalité. C’est aussi une révolution clivante.D’aucuns l’interprètent comme donnant lieu à de nombreuses perspectives positives en matière de respect du bien-être animal, voire en vue d’accorder des droits aux animaux non humains.D’autres estiment que la disposition constitutionnelle permettra tout au plus que leur situation ne s’empire pas, ou espèrent que celle-ci n’aura pas de conséquence concrète, au nom des intérêts humains.Le présent ouvrage développe les questions de :la protection des animaux non humains au travers de la place juridique qui leur a été accordée en Belgique depuis la loi fédérale protégeant leur bien-être et les évolutions du Code civil ;leur personnification juridique ;la reconnaissance constitutionnelle de leur qualité « d’êtres sensibles ».Hier, le droit se limitait à protéger leur « bien-être » ; aujourd’hui il leur fait une place dans sa norme juridique la plus importante. Peut-on imaginer que demain ils bénéficieront – à l’instar d’autres non-humains dans le monde – du mécanisme de la personnification juridique ?
