Het omgevingsrecht regelt de ordening en de bescherming van onze leefomgeving. Het gaat dan om het milieurecht, het natuurbeschermingsrecht, het ruimtelijk bestuursrecht, het waterrecht en de samenhang daartussen. Dit boek bevat de hoofdlijnen van het omgevingsrecht. Stapsgewijs wordt de lezer door het omgevingsrecht geleid, waarbij de doorwerking van het Europese omgevingsrecht op structurele wijze bij de verschillende onderwerpen wordt meegenomen. Vanzelfsprekend is er ook aandacht voor de handhaving van het omgevingsrecht en de rechtsbescherming tegen omgevingsrechtelijke besluiten. Deze druk is geheel geactualiseerd en aangepast aan recente ontwikkelingen in wetgeving, jurisprudentie en praktijk. Daarbij zijn onder meer de inwerkingtreding van de Wet natuurbescherming en de implementatie van de wijzigingsrichtlijn milieueffectrapportage meegenomen. Ook wordt ruim aandacht besteed aan het instrumentarium van de toekomstige Omgevingswet. Dit boek is primair bedoeld voor studenten op gevorderd bachelor- en masterniveau, maar kan zeker ook van nut zijn voor de rechtspraktijk. De auteurs Mr. dr. M.N. Biodiversity within the European Union is under threat. Almost a quarter of Europe's vascular plant species and 155 species of its native mammals, birds, reptiles and amphibians are threatened with extinction. The Habitats Directive imposes a strict regime for environmental protection. But with the euro zone economy falling from 'stagnation' to 'contraction' in the second quarter of 2012 and the UK entering into a 'double dip' recession in April 2012, European governments face an economic crisis. The English courts have said that the Directive should not become a property developer's obstacle course. Yet the tensions between environmental protection and economic growth are all too readily apparent with the UK government stating both that we must 'arrest the decline in habitats and species and the degradation of landscapes' and later that 'gold plating of EU rules on things like habitats' was putting 'ridiculous costs' on business enterprise. Heightened public awareness of the ever increasing loss of biodiversity has led to louder calls for effective nature conservation efforts. Most remaining biodiversity-rich areas are inhabited or used by indigenous peoples and local communities. In recent years a new 'paradigm' of 'nature conservation with respect for the rights of indigenous peoples and local communities' has emerged. Two questions arise: What exactly does this policy shift mean in terms of international human rights law? And how has this new paradigm been translated and applied at the national and local level? This study investigates how nature conservation initiatives interact with the rights of indigenous peoples and local communities from a human rights and legal anthropological perspective. The book is distinctive in that it provides a comprehensive review of international human rights law in the context of nature conservation; a critical appraisal of Peruvian nature conservation legislation in relation to the rights of indigenous peoples and local communities; and a thorough analysis of the interaction between three levels of regulation: the international level of human rights, the national level of Peru, and the local level of a specific protected area (the Güeppí Reserved Zone). It is based on extensive field work. This volume will be of interest to both academics and practitioners who are working in the fields of nature conservation, human rights or indigenous peoples' rights.
