This was the first major study of post-Civil War banking panics in almost a century. The author has constructed estimates of bank closures and their incidence in each of the five separate banking disturbances. The book takes a novel approach by reconstructing the course of banking panics in the interior, where suspension of cash payment, not bank closures, was the primary effect of banking panics on the average person. The author also re-evaluates the role of the New York Clearing House in forestalling several panics and explains why it failed to do so in 1893 and 1907, concluding that structural defects of the National Banking Act were not the primary cause of the panics.

ONDERNEMINGEN IN MOEILIJKHEDEN - De Wet van 31 januari 2009 (wet d.d. 31.01.2009 w.31.01.2009) betreffende de continuiteit van de ondernemingen vervangt de Wet van 17 juli 1997 betreffende het gerechtelijk akkoord en wordt op het vlak van de gerechtelijke organisatie aangevuld door de Wet van 26 januari 2009. Zij is vooral vernieuwend wat betreft de mogelijkheden die ze biedt aan ondernemingen in moeilijkheden. De wet reikt mogelijkheden aan om in te grijpen zodra de problemen zich stellen. De onderneming staat niet langer voor de keuze tussen gerechtelijk akkoord of faillissement maar beschikt integendeel over een waaier aan opties gaande van zeer vrije oplossingen zoals het minnelijk akkoord eventueel uitgewerkt en afgesloten met de hulp van een ondernemingsbemiddelaar tot striktere regelingen zoals de gedwongen overdracht onder gerechtelijk gezag met tussen beide het klassieke systeem van collectief plan tot schuldenregeling voorgesteld aan alle schuldeisers. Dit boek bevat een artikelsgewijze commentaar van de nieuwe wetgeving. Deze nieuwe wetgeving is niet alleen van toepassing op kooplieden en handelsvennootschappen maar ook op landbouw- en burgerlijke vennootschappen uitgezonderd de vrije beroepen. The 1997-1998 Asian financial crisis exposed serious deficiencies in the insolvency systems of many countries. In response, many governments have undertaken sweeping reforms to strengthen their insolvency systems and rebuild their economies, including promulgating new laws, introducing new procedures to facilitate restructuring, strengthening courts and related institutions, and recapitalising financial institutions. This volume brings together a comparative report and studies of the insolvency systems of Indonesia, Korea, Malaysia, the Philippines, Singapore and Thailand. These papers examine, among other things, the extent to which each country was affected by the financial crisis, the effectiveness and efficiency of formal and informal insolvency procedures, recent initiatives undertaken, and areas in need of further reforms. In addition, this publication includes an introductory note summarising the findings and conclusions from the November 1999 conference on "Insolvency Systems in Asia: An Efficiency Perspective".

Dans les premières années du XXIe siècle, une bulle se développa au sein de l'immobilier résidentiel américain. L'appréciation rapide du prix des maisons permit à des emprunteurs peu fortunés, regroupés au sein du secteur subprime, d'accéder au statut envié de propriétaires. La bulle requérait un flux constant de nouvelles recrues et quand celles-ci firent défaut en 2006, la bulle éclata : les prix de l'immobilier stagnèrent avant de partir à la baisse. Les emprunteurs subprime qui ne pouvaient faire face à leurs engagements sans une appréciation constante du prix de leur logement se retrouvèrent rapidement en situation délicate. La mise sur le marché de leurs logements ne fit qu'aggraver la crise. L'industrie financière s'était d'abord adaptée passivement à la bulle, elle la facilita ensuite en mettant au point de nouveauux types de prêt. La "titrisation" permit de regrouper des collection de plusieurs milliers de ces prêts sous la forme d'une obligation classique vendue à des investisseurs éparpillés à la surface de la planète. Quand un nombre important d'emprunteurs subprime jetèrent l'éponge, ces oblagations tombèrent sous la barre de la rentabilité, entraînant des pertes considérables pour les établissements financiers qui les détenaient dans leur portefeuille. Affaiblis, ceux-ci accordèrent de moins en moins de prêts, provoquant un tarissement du crédit qui ne tarda pas à affecter l'économie réelle dont la vitalité repose sur l'accès à ces capitaux. Tel est l'enchaînement qui a abouti à la crise financière majeure partie des Etats-Unis et qui ébranle ou menace le système bancaire de plusieurs pays européens. Anthropologue réputé, expert en intelligence artificielle et spécialiste de la formation des prix travaillant dans le monde bancaire, Paul Jorion jette depuis plusieurs années un autre regard sur l'économie ; il annonçait ainsi dès 2005 ce qui allait devenir la crise des subprimes.
