Abstract

Das Open-Access-Buch untersucht am Beispiel des Europäischen Gerichtshofs für Menschenrechte (EGMR) und des Interamerikanischen Menschenrechtsgerichtshofs (IAGMR), welche Rolle innerstaatliche Gerichte bei der Umsetzung internationaler Entscheidungen wahrnehmen. Wann sind sie bereit ihre Pendants in Straßburg bzw. San José bei der Umsetzung ihrer Entscheidungen zu unterstützen und diese gleichsam unmittelbar „anzuwenden“, und wo ziehen sie Grenzen und rote Linien? Was sind die Probleme, die ihnen begegnen, und befinden sich Gerichte tatsächlich im Wandel hin zu einer defensiveren und weniger völkerrechtsfreundlichen Haltung, wie einige jüngere Beispiele vermuten lassen? Das Werk widmet sich der Frage, welche Wirkungen innerstaatliche Gerichte bereit sind, den Entscheidungen der Menschenrechtsgerichte zukommen zu lassen – und zwar genau dann, wenn sich das innerstaatliche Recht nicht dazu äußert. Es zeigt auf, dass hinter der vermeintlich technischen Ausgangsfrage fundamentale Fragen verfassungsrechtlicher Natur stehen und sich am Beispiel der Menschenrechtsgerichte einige der zentralen Schwierigkeiten und Probleme zeigen, wie sie beim Zusammenspiel von Rechtsordnungen in Zeiten globalen Regierens entstehen. .

Abstract

It analyses substantive standards, powers, procedures as well as the consequences and implications of the various instruments. It combines the analysis of the European level, be it the EU or the Council of Europe, with that of the national level, in particular in Hungary and Poland. The LM judgment of the European Court of Justice is made subject to detailed scrutiny.

Abstract

This book considers the European Union as a project with a major antidiscrimination goal, which is important to remember at a time of increasing resentment against particularly exposed groups, especially migrants, refugees, members of ethnic or religious minorities and LGBTI persons. While equality and non-discrimination have long been core principles of the international community as a whole, as is made obvious by the UN Charter and the Universal Declaration of Human Rights, they have shaped European integration in a particular way. The concepts of diversity, pluralism and equality have always been inherent in that process, the EU being virtually founded on the values of equality and non-discrimination. The Charter of Fundamental Rights of the EU contains the most modern and extensive catalogue of prohibited grounds of discrimination, supplementing the catalogue enshrined in the European Convention on Human Rights. EU law has given new impulses to antidiscrimination law both within Europe and beyond. The contributions to this book focus on how effective and credible the EU has been in combatting discrimination inside and outside Europe. The authors present different (mostly legal) aspects of that topic and examine them from various intra- and extra-European angles.

Abstract

In diesem Open-Access-Sammelband werden die aktuelle Herausforderungen für Privatheit und Datenschutz aufgezeigt, die durch die zunehmende Digitalisierung entstehen. Die Beitragsautoren analysieren, wie diese durch Governancemechanismen adressiert werden können. Als Alternative zu einem rein profitorientierten Digitalkapitalismus bzw. Digitalautoritarismus wird für einen eigenständigen europäischen Weg beim Datenschutz argumentiert, der auf eine gemeinwohlorientierte Technikentwicklung abzielt. Insbesondere befassen sich die Beiträge mit den Möglichkeiten für die Stärkung der Selbstbestimmung in der Datenökonomie und mit algorithmischen Entscheidungssystemen. Die Herausgeber Dr. Michael Friedewald leitet das Geschäftsfeld „Informations- und Kommunikationstechnik“ am Fraunhofer Institut für System- und Innovationsforschung in Karlsruhe. Er befasst sich u.a. mit Auswirkungen neuer Technologien auf Datenschutz und Privatheit. Dr. Michael Kreutzer verantwortet beim Darmstädter Fraunhofer SIT-Institut den Bereich „Internationalisierung und strategische Industriebeziehungen“. Herr Kreutzer forscht und publiziert seit mehr als 20 Jahren zu Fragestellungen des technischen Privatsphärenschutzes und der IT-Sicherheit. Marit Hansen ist die Landesdatenschutzbeauftragte Schleswig-Holstein und leitet das Unabhängige Landeszentrum für Datenschutz Schleswig-Holstein (ULD). Sie ist Informatikerin und Autorin vieler Veröffentlichungen zur datenschutzgerechten Gestaltung von IT-Systemen. Alle Herausgeber sind Mitglieder des „Forum Privatheit und selbstbestimmtes Leben in einer digitalen Welt“.

Abstract

This is the conference book for the XIV European Regional Congress of the International Society for Labour and Social Security Law, dedicated to the interactions between social law and other areas of law. In recent years, labour law and social security law have been subject to various reforms and developments. Social law is however not an isolated domain but rather interacts with other fields, often even functioning as a guide or giving direction to those lost at sea. In other words: serving as a lighthouse. The key aspect addressed in this book is the existence of a connection between social law sensu stricto (labour law and social security law) and other areas of law. Pursuing an inter- and multidisciplinary approach, it gathers contributions on topical and challenging issues in four broad areas: 1. Basic and fundamental principles of European social law 2. The future in the light of the past 3. The impact of regionalisation 4. Enforcement in social law In turn, various developments can be identified in connection with these topics: the emergence of social criminal law is creating new overlaps between social and criminal law; the growing number of administrative law sanctions offers new insights into and connections between social security law and administrative law; the increasing similarity of employment in the public and private sectors raises questions about the applicability of administrative law in labour law relations; the relation between the ECHR and the articles of the Constitution opens up new perspectives on the constitutional interpretation of freedoms and on the interaction between human rights, constitutional law and social law; and lastly, there is a growing influence of EU law and international treaty law (concerning trade) on social law. Can we, by looking at these developments, draw certain conclusions at a different and innovative level? The contributions were selected by an international working group of distinguished scholars from across Europe.

Abstract

This book demonstrates how human rights obligations of the EU foreign constitution can be operationalized in the realm of international economic regulation. The content is divided into three major parts. The first outlines the legal foundations needed for the EU to become a shaper of international investment law, which include the general principles and objectives of EU external policies, the Charter of Fundamental Rights, international human rights and the international investment competences of the EU. The second part demonstrates the current international investment regime’s incompatibility with human rights interests, while the third analyzes two mechanisms stemming from trade Law – ex-ante human rights impact assessments and civil society monitoring bodies – and explores whether they could mitigate the current inequalities in the protection of rights. The potential of these mechanisms, the book argues, lies in their capacity to ensure a comprehensive assessment of all interests at stake, and to empower traditionally marginalized rights-holders to make, shape and contest the international investment regime.

Abstract

This book employs methods from comparative law to analyze voluntary migration, exploring the free movement of immigrants and their freedom of settlement under Brazilian and Mercosul law, as well as under German law and the European Union’s legal framework on migration. It discusses the level of protection granted to immigrants in terms of their right to enter and stay in Brazil and Mercosul, using German legislation and the EU’s legal framework on migration for comparison. Accordingly, the book will help migration researchers to understand not only the structure and rationale of migration law in Brazil, especially after the entry into force of its recent Migration Law in 2017, but also its relation to EU and German provisions on voluntary migration. It demonstrates how the differing natures of the migration law adopted by Brazil and Germany have led to different approaches and, consequently, different levels of protection for immigrants.

Abstract

This interdisciplinary book consists of three parts which examine the European Union policies on research and innovation, education and life-long learning, as well as the European Union Pillar on social rights and youth policies. In the first part, high-level experts analyze the European Research Area and its current enhancement, with emphasis on mobility and employability of researchers, especially in times of crises. In the second part, the governance architecture of the European Education Area(s) is explored and the new objectives of the Bologna Process, as well as the EU institutional framework of the recognition of skills and qualifications, are analyzed. Life-long learning is also important for the individual development of human capital especially for socially vulnerable people who could also benefit from literacy policies and skills development. The second part concludes with the evaluation of the EU education and training policy based on social indicators in the framework of the EU 2020 Strategy. In the third part, the book turns to Social Europe and the balancing between ordo-liberalism and ordo-socialism. It examines the EU Pillar of Social Rights and its impact on youth policies. It analyzes the EU youth policies e.g. on youth credit and their interaction with young people’s employment and education possibilities, with emphasis on the young people "not in education, employment or training" (NEETs).

Abstract

This book addresses intersex rights violations and analyses intersex people’s legal demands as expressed by intersex activists themselves and delivered through statements and reports issued by intersex rights organisations, the United Nations and the Council of Europe. Intersex people are born with sex characteristics that do not fit typical notions of male or female bodies, as a result of which they are stigmatised, marginalised and denied the recognition of their fundamental rights. Often, they are subjected to involuntary and harmful sex “normalising” surgeries at birth, which violate their bodily integrity, self-determination and informed consent, so as to comply with societal and legal norms. Moreover, binary legal frameworks prevent them from enjoying the rights to access identification documents, start a family, or be free from discrimination in all areas including employment and sports. To elaborate on intersex violations that emanate from binary laws, this book examines the situation of intersex rights in regional jurisdictions worldwide and within the European Union in particular. In the process, it identifies current legal barriers and suggests how intersex people could be accommodated under legal frameworks and achieve sex/gender equality beyond binary definitions.
