Abstract

At the summit in Laeken in December 2001 the European Council opened the debate on the reform of the supranational structures through its "Declaration on the Future of the European Union" and proposed a wide-ranging agenda. The European Convention, with the mandate of the European Council, has been forming proposals for a more democratic, transparent and efficient European Union and presented a draft of a Treaty establishing a Constitution for Europe on 20th of June 2003. On these fundaments the Intergovernmental Conference finally came to a compromise in summer 2004 after wrestling especially with the problem of qualified majority voting within the Council. On 29th of October 2004 the Heads of State and Governments of the 25 Member States signed the Treaty. After the French and Dutch citizens refused their approval of the Treaty in referendums the future of the draft Constitution remains uncertain. The volume contains articles from high-ranking experts from politics and academia of different Member States about the basic principles of the actual constitutional law of the European Union and its need of reform through a Constitution for Europe. By analysing the rules to govern a Europe of 25 and in time 28 and more Member States the publication intends to make a contribution to the emerging "Ius Publicum Europaeum".

Abstract

There is much confusion over the 'Constitution', and this book provides an in-depth legal analysis of the institutional aspects of the Constitutional Treaty which, if ratified by the 25 EU Member States, would govern the European Union. Piris argues that, despite its ratification being rejected by the French and the Netherlands referenda in 2005, the Treaty should not be discarded, as it will inevitably be the point of departure for the future of European integration. He places this analysis in an historical and political context and explains the origin, meanings and legal and political effects of all proposed changes to the present treaties.

Abstract

The Politics of Crisis in Europe explores the resilience of the European Union in the face of repeated crises perceived to threaten its very existence. While it is often observed after the fact that these crises serve as opportunities for integration, this is the first critical analysis to suggest that we cannot fully understand the nature and severity of these crises without recognising the role of societal reaction to events and the nature of social narratives about crisis, especially those advanced by the media. Through a close examination of the 2003 Iraq crisis, the 2005 constitutional crisis, and the 2010-12 Eurozone crisis, this book identifies a pattern across these episodes, demonstrating how narratives about crises provide the means to openly air underlying societal tensions that would otherwise remain under the surface, impeding further integration.
