"Two and a half years on, the EU and Investment Agreement conference was convened to assess crucial issues that remain open. This volume, which comprises the papers presented in the conference, focuses on such topical and highly-debated issues which include the role of the Member States in the negotiation and conclusion of future EU investment agreements, the inclusion of investor-state dispute settlement provisions in these agreements, as well as the status of national investmtent insurance systems in the wake of the Treaty of Lisbon"--Back cover

One of the most important characteristics of today's private law is that it increasingly flows from different sources: Next to national legislation and case law, it is also shaped by European and supranational sources and rapidly becoming a mixture of differently oriented rules and principles. This development can be described as one from coherence to fragmentation. The aim of the new book is to consider how this important shift has worked out in different subfields of the law like in contract and property law, in competition, insurance, marketing and private international law as well as in the law of intellectual property. This cross-disciplinary approach shows how pervasive legal fragmentation has become, and points out how to remedy the adverse effects it brings with it. The volume is therefore indispensable for anyone interested in how Europeanisation affects national private laws.

The volume of European Union legal acts relating to commercial law is staggering. This book provides a clear and concise overview of the vast bulk of European Union business law, giving extensive coverage to both legislation and the decisions of the Court of Justice. The text is fully up to date in the light of the Treaty of Lisbon. The book approaches European Union business law from the perspective of non-Member common law nations such as the United States, Australia and Canada. An Appendix contains model problem questions. Each chapter contains extensive references to other books, articles and websites for further reading. “By collecting the material; organising it so skilfully; presenting it so clearly; and summarising it so succinctly, the authors have also worked a kind of miracle. Their efforts will be appreciated by legal practitioners, judges, scholars and teachers within and outside the EU because they have made the essence of EU commercial law available in a single book.” The Hon. Michael Kirby AC CMG, former Justice of the High Court of Australia (1996-2009).
