Le président des États-Unis serait l'homme – ou la femme – le plus puissant de la planète. Cette perception commune, sans cesse alimentée par les productions d'Hollywood, n'en est pas moins fausse. Contraint par les multiples obstacles des checks and balances constitutionnels, le président doit notamment faire face au Législatif le plus puissant et le plus autonome du monde. La séparation des pouvoirs a en effet permis au Congrès de se construire comme un partenaire indomptable, et souvent capricieux, de la Présidence sans que celle-ci ne puisse intervenir. Le contrôle législatif ainsi créé et protégé repose en particulier – c'est là l'argument central de cet ouvrage – sur la chambre haute, le Sénat, qui dispose en son sein de multiples ressources procédurales lui permettant de bloquer les initiatives présidentielles. Le filibuster, la possibilité laissée à un seul sénateur de s'exprimer sans interruption et sans autre limite que celle de sa résistance physique, en est l'exemple le plus célèbre. Au pays de la séparation des pouvoirs, il existe ainsi un contrôle politique direct, souvent brutal, qui s'exerce en permanence sur l'Exécutif, reléguant le président, dans le meilleur des cas, à un statut d'habile négociateur, bien loin de l'image de héraut du monde libre. En mobilisant le droit constitutionnel, l'histoire et la science politique, cet essai se propose de mettre en relief les modalités d'action du Congrès, et notamment du Sénat, pour souligner que la Présidence impériale est au contraire, pour reprendre le mot de Gerald Ford, bien souvent en péril.

Explaining outcomes of decision-making at the European level has occupied scholars since the late 1950s, yet analysts continue to disagree on the most important factors in the process. In this book, Arne Niemann examines the interplay of the supranational, governmental and non-governmental actors involved in EU integration, along with the influence of domestic, supranational and international structures. The book restates and develops neofunctionalism as an approach for explaining decisions in the European Union and assesses the usefulness of the revised neofunctionalist framework on three case studies: the emergence and development of the PHARE programme, the reform of the Common Commercial Policy, and the communitarisation of visa, asylum and immigration policy. Niemann argues that this classic theory can be modified in such a way as to draw on a wider theoretical repertoire and that many micro-level concepts can sensibly be accommodated within his larger neofunctionalist framework.

The Powers of the Union develops and tests a new theory of centralization and bureaucratization in the European Union. Using original data spanning five decades and a multi-method approach, Franchino argues that most EU laws rely extensively on national administrations for policy implementation and provide for ample national discretionary authority, while limiting tightly the involvement of the European Commission. However, when Council ministers do not share the same policy objectives, some have the incentive to limit national executive discretion and to rely more on the Commission. Majority voting facilitates this outcome, but the limited policy expertise of supranational bureaucrats and their biased views impede extensive supranational delegation. Finally, the European Parliament systematically attempts to limit national discretion, especially when its views differ from ministerial opinions, and tries to increase the Commission's policy autonomy. The book contributes towards understanding political-bureaucratic relations and evaluates the implications for EU democracy and subsidiarity.
