El conocimiento se ha convertido en el bien más valioso en la sociedad actual, pero la producción de conocimientos tecnológicos no es uniforme. Diferentes estudios muestran que solamente un 15% de la población mundial provee la mayor parte de las innovaciones tecnológicas en el mundo, mientras que menos de la mitad de la población mundial es capaz de adaptar esas tecnologías en la producción y consumo. El resto de la población (una tercera parte) se encuentra tecnológicamente aislada, sin capacidad de adaptar tecnologías extranjeras o de iniciar procesos de innovación propios. La transferencia de tecnología se erige como la solución más adecuada a esta situación de concentración del conocimiento, y una de las vías más importantes para realizar dicha transferencia es mediante diferentes figuras contractuales que a pesar de su diversidad presentan elementos comunes. Una de las características más importantes de estas figuras contractuales es su atipicidad, situación que conduce a que el principio de la autonomía de la voluntad cobre una gran importancia tanto en su vertiente material como conflictual. De igual manera, otro de los rasgos fundamentales de estos contratos es la asimetría en el poder de negociación de las partes, lo cual, aunado a su carácter atípico, conduce a que estos sean un terreno fértil para que se presenten abusos en la parte fuerte de la relación. En este libro se analizan las conductas más frecuentes en la práctica negocial internacional que pueden constituir abusos en los contratos de transferencia de tecnología y se estudian los diversos sectores del ordenamiento jurídico que regulan estos contratos, incluidos los asuntos relacionados con el Derecho internacional privado de los contratos, por medio de antecedentes jurisprudenciales y casos hipotéticos en Estados Unidos, la Unión Europea y América Latina.
