Das Problem der römischen Korreal- und Solidarobligationen ist mit der theologischen Frage der Dreieinigkeit zu vergleichen, wie Rudolf von Jhering, einer der berühmtesten Juristen des 19. Jahrhunderts in „Scherz und Ernst in der Jurisprudenz – Eine Weihnachtsgabe für das juristische Publikum“ 1884 formulierte: Es sei schlicht nicht theoretisch lösbar, sondern allenfalls auf rechtspraktischem Wege. Die gewissermaßen überzeitlichen Fragen treten auch heute noch in gleicher Weise auf, etwa wenn Partner einer nichtehelichen Lebensgemeinschaft eine Wohnung anmieten. In der Folge sind beide dem Vermieter zur Zahlung des vollen Mietzinses verpflichtet, der Vermieter soll die Miete insgesamt aber nur einmal erhalten. Obwohl das BGB die römischrechtlichen Ideen nicht vollständig übernommen hat, stellen sich die alten Probleme, wenn auch in neuer Verkleidung, immer wieder und sind letztlich ebenso ungelöst wie die Deutung der antiken Quellen. Die Arbeit Steiners geht zurück an die Wurzeln des römischen Rechts und macht deutlich, daß ein Verständnis der antiken Vorstellungen nur möglich wird, wenn die praktische Umsetzung der überlieferten Quellen im Gerichtsverfahren mit bedacht wird. Es zeigt sich einmal mehr, daß die römischen Juristen keine rechtwissenschaftlichen Glasperlenspiele betrieben haben, sondern solche eher den pandektistischen Lehren des 19. Jahrhunderts zuzurechnen sind, welche auf die Schaffung des BGB maßgeblich eingewirkt haben. Der rechtslogische Mythos der Solidarobligationen löst sich auf, wenn der enorme rechtspraktische Sinn der damaligen Fachjurisprudenz und die römische Prozeßordnung zur Grundlage der Quelleninterpretation gemacht werden.
