How can we best protect the polar marine environment against pollution? Leading scholars on environmental law, the law of the sea, and Arctic and Antarctic affairs here examine this important question. To what extent do existing global instruments of environmental protection apply to the Arctic Ocean and the Southern Ocean? Can the arrangements adopted at regional, sub-regional and national levels provide adequate protection? This book examines and compares various levels of regulation in protecting the marine environment of the Arctic and Antarctic, with specific attention to land-based activities, radioactive waste dumping, and shipping in ice-covered waters. Developments since the establishment of the Arctic Council in 1996 and the entry into force of the Protocol on Environmental Protection to the Antarctic Treaty in 1998 are also discussed. This is a volume that will appeal to polar specialists and to all those interested in environmental law and policy.

States and entrepreneurs are becoming increasingly interested in the economic potential of ocean areas beyond the national jurisdiction of coastal States, namely the high seas and the Area. This has led to growing support within the international community to enhance the international legal regime for those areas, among other things to protect and preserve the environment and biodiversity. However, the current debate in international fora indicates that States have widely different interpretations on key aspects of this regime. For instance, what implications do the principles contained in the United Nations Convention on the Law of the Sea have for the governance and regulation of these areas, how is access to natural resources best regulated, how are benefits derived from these areas to be distributed and which specific institutional frameworks should be employed in the management of areas beyond national jurisdiction? This work intends to contribute to a better understanding of the international law aspects of the ongoing debate on current and future international governance and regulation of areas beyond national jurisdiction. To this end four specific topics are examined: principles and objectives of the legal regime; institutional arrangements for the legal regime; entitlements to marine living resources; and compliance with international regulations.

Marine Protected Areas in International law – an Arctic perspective , introduces and analyzes the legal rights and obligations of states under international law, using Marine Protected Areas (MPAs) as a tool to protect marine biodiversity. The fragile Arctic marine environment is under growing pressure from climate change and the prospect of increasing human activity affecting previously untouched areas. The conservation of Arctic marine biodiversity is a pressing and global concern, not least because the melting of sea ice will have widespread effects. By analyzing regional cooperation through the OSPAR Convention and under the Arctic Council, Jakobsen examines the implementation of the global legal framework for biodiversity protection and conservation in the Arctic. The book has a particular focus on the possibilities of the states to regulate shipping within the MPAs, as the increasing shipping activities represent a major threat to the sensitive marine Arctic.

In May 2005, the International Max Planck Research School for Maritime Affairs organized an international conference addressing marine pollution. At the conf- ence venue, the International Tribunal for the Law of the Sea, academics and practitioners debated recent developments from an interdisciplinary perspective. The papers shed light upon ecological aspects, upon the efforts of the international community to prevent and combat marine pollution by appropriate institutions and regulations, and upon the compensation of losses which have occurred despite those efforts. The present volume collects the papers of the conference and at the same time conveys an impression of the diversity of subjects discussed in the International Max Planck Research School for Maritime Affairs. The European Community and its member states have shared competences in marine environmental matters. As a consequence, they have jointly acceded to the United Nations Convention on the Law of the Sea (LOSC) and most marine-related international agreements, which have been concluded in form of “mixed agreements”. This book looks at the manner in which the Community implements its international obligations in the specific fields of the prevention of oil pollution from ships, the regulation of ocean dumping and the protection of marine habitats through the establishment of Marine Protected Areas (MPAs), especially looking at the division of competence with the member states and the conformity of the Community’s regulatory action with the jurisdictional framework established by the LOSC. By examining the subject from both a law of the sea and EC law perspectives, the books offers a comprehensive and interesting picture of the action taken by the Community to preserve the European marine environment.
