Abstract

Heightened public awareness of the ever increasing loss of biodiversity has led to louder calls for effective nature conservation efforts. Most remaining biodiversity-rich areas are inhabited or used by indigenous peoples and local communities. In recent years a new 'paradigm' of 'nature conservation with respect for the rights of indigenous peoples and local communities' has emerged. Two questions arise: What exactly does this policy shift mean in terms of international human rights law? And how has this new paradigm been translated and applied at the national and local level? This study investigates how nature conservation initiatives interact with the rights of indigenous peoples and local communities from a human rights and legal anthropological perspective. The book is distinctive in that it provides a comprehensive review of international human rights law in the context of nature conservation; a critical appraisal of Peruvian nature conservation legislation in relation to the rights of indigenous peoples and local communities; and a thorough analysis of the interaction between three levels of regulation: the international level of human rights, the national level of Peru, and the local level of a specific protected area (the Güeppí Reserved Zone). It is based on extensive field work. This volume will be of interest to both academics and practitioners who are working in the fields of nature conservation, human rights or indigenous peoples' rights.

Abstract

On connaissait déjà, de longue date, les parcs et les espaces verts : soigneusement aménagés et jalousement gardés, ils rompent la monotonie de l'espace bâti en y introduisant une image de nature « civilisée ». En revanche, on redécouvre seulement aujourd'hui, à la lisière de nos cités, les sites semi-naturels, qui, parce qu'ils ont été le plus souvent laissés à l'abandon, nous livrent quelque chose de la nature « naturelle ». Les biologistes ont mis en lumière la richesse de leur écosystème, la variété de leur faune et de leur flore. C'est cependant à une autre forme de « défense et d'illustration » que s'attache cet ouvrage. Au-delà de leur diversité biologique, il restait en effet à faire apparaître leur valeur sociale : une analyse sociologique approfondie s'y emploie qui met en lumière les multiples images que s'en font les habitants de la ville, ainsi que les divers usages qui s'y développent. Ressources biologiques uniques en milieu urbain, et enjeux d'usages tantôt complémentaires, tantôt opposés, les sites semi-naturels appellent une gestion démocratique et un traitement juridique protecteur. C'est à l'étude des virtualités des instruments juridiques disponibles que s'attache la seconde partie de l'ouvrage. Un cadre est ainsi dressé en vue d'assurer une protection réelle de ces espaces-lisières qui occupent d'ores et déjà une place de choix dans le patrimoine commun des citadins. Six sites bruxellois ont été choisis en raison de leur valeur illustrative : le Kauwberg, le Scheutbos, le Moeraske, le Neerpede, le Kattebroeck, ainsi que le plateau de la Foresterie. Ces deux études ont été menées à l'initiative du fonds de l'environnement de la fondation Roi Baudouin.

Abstract

Men kent al sinds lang parken en groene zones : zorgvuldig aangelegde en goed bewaakte zones die de monotonie van de bebouwing doorbreken en voor een vleugje «beschaafde» natuur in de stad zorgen. Maar nu pas ontdekt men aan de rand van onze Steden de half-naiuurlijke gebieden die lange tijd werden verwaarloosd en zo een stukje «natuurlijke» natuur in de stad brengen. Biologen wijzen op de rijkdom van nun ecosysteem, op de verscheidenheid van nun fauna en flora. Maar dit boek beoogt een andere vorm van verdediging en waardering van die gebieden. Naast de biologische verscheidenheid moest immers ook de maatschappelijke waarde van die gebieden aan bod kunnen komen : dat is precies de opzet van een diepgaande sociologische analyse waaruit blijkt welke voorstellingen de stadsbewoners zieh van die gebieden maken en welke vormen van gebruik er zieh ontwikkelen. Als unieke bronnen van biologische rijkdom in een stedelijk milieu en als inzet van gebruikte vormen die elkaar soms aanvullen, soms uitsluiten, vragen de half-natuurlijke gebieden om een demoeratisch beheer en om juridische bescherming. Het tweede deel van het boek bestudeert dan ook de mogelijkheden die het beschikbare juridische instrumentarium biedt. Aldus wordt een omkadering gecreeerd die de randgebieden tussen stad en natuur, die nu reeds een belangrijk element vormen van het gemeenschappelijke erfgoed van de stadsbewoners, daadwerkelijke bescherming verzekert. Er werden zes illustrative Brusselse gebieden geselecteerd : de Kauwberg, het Scheutbos, het Moeraske, de Neerpede, het Kattebroeck en het plateau van de Vorsterie. Beide studies werden uitgevoerd op initiatief van het Fonds Leefmilieu van de Koning Boudewijnstichting.
