The development of international law is conventionally understood as a history in which the main characters (states and international lawyers) and events (wars and peace conferences) are European. Arnulf Becker Lorca demonstrates how non-Western states and lawyers appropriated nineteenth-century classical thinking in order to defend new and better rules governing non-Western states' international relations. By internalizing the standard of civilization, for example, they argued for the abrogation of unequal treaties. These appropriations contributed to the globalization of international law. With the rise of modern legal thinking and a stronger international community governed by law, peripheral lawyers seized the opportunity and used the new discourse and institutions such as the League of Nations to dissolve the standard of civilization and codify non-intervention and self-determination. These stories suggest that the history of our contemporary international legal order is not purely European; instead they suggest a history of a mestizo international law.

Le droit international privé repose traditionnellement sur un paradigme étatique que laffaiblissement de lÉtat-Nation est venu ébranler. Lérosion du modèle westphalien de la souveraineté renouvelle les sources de la matière au détriment des intérêts étatiques, alors que, parallèlement, ceux-ci sont de plus en plus présents dans les relations privées internationales du fait de la concurrence législative. LÉtat doit donc trouver des remèdes à ce paradoxe, sans pour autant infléchir sa politique libérale, car un véritable droit à la mobilité internationale est apparu dont lautonomie de la volonté constitue le corollaire et la protection des personnes privées lobjectif. Entre intérêts privés et intérêts étatiques, les méthodes du droit international privé doivent se redessiner sur un mode fonctionnaliste. LÉtat étant largement dépassé par le degré dinternationalité des rapports privés et par les pouvoirs privés, le succès de cette méthode implique quil agisse en synergie avec les autres ordres juridiques. Le pluralisme juridique, facteur de déclin, devient alors une force.

Fragmentation is currently discussed mainly in the context of international law; this book shows that the complexity of regulations and multiplicity of institutions in a non-hierarchical order lead to fragmentation in national legal systems as well as in international law. However, the aim of the book is not merely to describe contemporary fragmented law, but rather to offer arguments for strengthening the systemic character of law. The book explores methods of pro-systemic interpretation, the principle of proportionality, legal pluralism, and these analyses result in the conception of normative coherentism. While the vast majority of scholarship associates coherentism with epistemological issues, such as the coherence theory of truth, this work emphasises the importance of an approach to law that focuses on the underlying principles and doctrines that form its foundations, as well as the connections between the various elements of the legal system that need to be discovered through the doctrinal study of law. The axiological, not axiomatic, nature of law, complexity theory and common foundations of simultaneously applicable legal systems are described as the basic premises of normative coherentism. The author outlines manifestations of normative coherentism in various processes in law, especially in law- and decision-making.
