Cette thèse analyse les développements normatifs et jurisprudentiels inspirés de la citoyenneté de l'Union, instaurée par le traité de Maastricht de 1992. La première partie traite des apports réels et potentiels de la citoyenneté européenne au principe de non-discrimination. La Cour a fait de ce principe une composante essentielle de la citoyenneté européenne, élargissant ainsi le domaine d'application personnel et matériel de l'article 12 CE. Cette démarche jurisprudentielle a entraîné des conséquences importantes sur le statut social du migrant communautaire inactif, notamment concernant la question de son accès aux prestations sociales dans l'État d'accueil. Cette question présente un intérêt particulier pour deux catégories de migrants, les étudiants et les demandeurs d'emploi. Le rattachement du principe d'égalité à la citoyenneté européenne conduit, par ailleurs, à aborder deux thèmes connexes: la nécessité de corriger les "discriminations à rebours" et la relation entre la citoyenneté européenne et les droits fondamentaux. La seconde partie de cette thèse se penche sur les progrès réalisés ainsi que ceux anticipés en matière de libre circulation des personnes. Attribut "constitutionnel" de la citoyenneté européenne, le droit de séjour est désormais régi par une nouvelle directive (2004/38), qui remplace un dispositif particulièrement complexe et parfois obsolète. À côté de l'analyse de cet instrument législatif, la thèse examine le mouvement jurisprudentiel tendant à mettre en valeur l'article 18 CE. Sont alors abordées en détail l'affirmation de l'effet direct de cet article et la nouvelle interprétation des limites posées au droit de séjour (réserve d'ordre public, possession des ressources suffisantes et d'une assurance maladie). Sont également examinées des questions relatives au champ d'application personnel et matériel de l'article 18 CE, son articulation avec les dispositions du traité consacrant les libertés économiques et la possibilité d'exporter certains types de prestations de sécurité sociale.
