"International child abduction occurs when one parent wrongfully (ie in breach of the parental responsibility of the other parent) takes a child to a country other than that of the child's habitual residence, or wrongfully keeps a child in such country. The author of this work was part of a research team that conducted a study, partially funded by the European Commission, to examine this problem in Belgium and Hungary, analysing cases from 2007 and 2008 and interviewing affected parents. This book is a revised version of the Belgian research report, which sets the problem of child abduction within its international context. It looks at the families in which abductions took place, how preparations were made for abduction, the quest for the return of the child (including legal proceedings) and the aftermath of the abductions. Throughout the book, the results of the quantitative and qualitative data are explained. What emerges is that when a child is abducted, the solutions offered by the law are often inadequate. Family conflict is a complex societal issue, and child abduction is a severe form of family conflict. Rather than responding to child abduction with strict and contentious legal proceedings, the book argues that solutions based on respect, psychological assistance, and a search for consensus should be favoured"--Provided by publisher. It sheds light on the operations of the Hague Child Abduction Convention of 1980, on Brussels IIa (referred to in the book as Brussels IIbis), on the bilateral agreements that Belgium has with Morocco and Tunisia, and on cases of child abduction where no international instrument applied. Comment les adolescents qui vivent en alternance chez leur père et leur mère séparés ou divorcés, construisent-ils et définissent-ils leur place au sein de chacun de leur foyer ? Comment expérimentent-ils ce mode de vie, marqué par l'alternance entre deux 'maisons' aux univers parfois fort différents, et entre lesquels les parents tracent parfois des frontières imperméables ? Comment s'organisent-ils au quotidien pour gérer leurs affaires, s'approprier un territoire personnel, et maintenir une forme de présence dans le foyer qu'ils quittent une semaine sur deux ? À quelles difficultés sont-ils confrontés, et quelles ressources mobilisent-ils pour y faire face ? C'est cette expérience vécue qui est au cœur de cet ouvrage unique, au travers des témoignages de 21 adolescents âgés de 10 à 16 ans qui vivent en hébergement égalitaire - ou « garde alternée » -, et recueillis par une équipe de sociologues de l'UCLouvain. les auteures invitent le lecteur à suivre les jeunes dans leur périple, qui démarre avec l'emballage de leurs affaires et le voyage entre les deux domiciles, se poursuit avec l'arrivée au domicile de destination, où se déploient des routines et rituels de 'retour' ; se prolonge le temps de la présence sur place, où les enfants définissent, négocient et s'approprient une place au sein de la famille et un sens particulier du chez-soi ; et s'achève sur un nouveau départ qui pose la question du maintien d'une présence symbolique pendant l'absence. ce faisant, les auteures donnent à voir de multiples manières de vivre et d'organiser l'hébergement égalitaire, et offrent de nouveaux outils pour penser et accompagner ce mode de vie.
