The development of international law is conventionally understood as a history in which the main characters (states and international lawyers) and events (wars and peace conferences) are European. Arnulf Becker Lorca demonstrates how non-Western states and lawyers appropriated nineteenth-century classical thinking in order to defend new and better rules governing non-Western states' international relations. By internalizing the standard of civilization, for example, they argued for the abrogation of unequal treaties. These appropriations contributed to the globalization of international law. With the rise of modern legal thinking and a stronger international community governed by law, peripheral lawyers seized the opportunity and used the new discourse and institutions such as the League of Nations to dissolve the standard of civilization and codify non-intervention and self-determination. These stories suggest that the history of our contemporary international legal order is not purely European; instead they suggest a history of a mestizo international law.

« Le Canada demeure un pays colonialiste, même si bien des Canadiens l'ignorent. Du suicide de victimes de viol aux enfants terrorisés et aux jeunes qu'on envoie à l'école du crime, la prison, le dérapage du système de « justice » en milieu autochtone sème le désespoir. Mais les solutions existent et en travaillant de concert, avec respect et compassion, autochtones et non-autochtones peuvent ensemble restaurer le contrôle social de ces communautés que le colonialisme a tenté d'étouffer. Le chemin difficile de la décolonisation est à notre portée si nous acceptons de passer par le pluralisme juridique en reconnaissant les traditions juridiques autochtones, leurs systèmes de gouvernance et leur autodétermination ; ce n'est qu'à ce prix que nous pourrons véritablement envisager la réconciliation. » --

In the process of globalisation, international law plays a crucial and ambivalent role. It is one of the driving forces behind the integration of markets, expanding standards of human rights and good governance as well as mechanisms for international peace and security. International law also responds to a globalised world which catalyses not only universal ethics, but also the global spread of risks to political and economic stability. "Evolutive interpretation" of international agreements affects traditional concepts of sovereignty and democratic legitimacy. It enhances the power of technocratic elites. At the same time, we witness an intensive interplay between the different sectors of international law; new layers of 'hard' and 'soft' normativity as well as intriguing forms of legal pluralism.

Advances an interesting perspective in world history, arguing that institutions and culture - and not just the global economy - serve as important elements of international order. Focusing on colonial legal politics and the interrelation of local and indigenous cultural contests and institutional change, the book uses case studies to trace a shift in plural legal orders - from the multicentric law of early empires to the state-centered law of the colonial and postcolonial world. In the early modern world, the special legal status of cultural and religious others itself became an element of continuity across culturally diverse empires. In the nineteenth century, the state's assertion of a singular legal authority responded to repetitive legal conflicts - not simply to the imposition of Western models of governance. Indigenous subjects across time and in all settings were active in making, changing, and interpreting the law - and, by extension, in shaping the international order.

In Indonesia, the world's largest Muslim-majority country, Muslims struggle to reconcile radically different sets of social norms and laws, including those derived from Islam, local social norms, and contemporary ideas about gender equality and rule of law. In this 2003 study, John Bowen explores this struggle, through archival and ethnographic research in villages and courtrooms of the Aceh Province, Sumatra, and through interviews with national religious and legal figures. He analyses the social frameworks for disputes about land, inheritance, marriage, divorce, Islamic History and, more broadly, about the relationships between the state and Islam, and between Muslims and non-Muslims. The book speaks to debates carried out in all societies about how people can live together with their deep differences in values and ways of life. It will be welcomed by scholars and students across the social sciences, particularly those interested in anthropology, cultural sociology and political theory.

Common Law, Civil Law, and Colonial Law builds upon the legal historian F.W. Maitland's famous observation that history involves comparison, and that those who ignore every system but their own 'hardly came in sight of the idea of legal history'. The extensive introduction addresses the intellectual challenges posed by comparative approaches to legal history.
