Long description: Zur Regulierung von politischen und sozialen Konflikten werden Menschenrechte oft als normative Leitidee ins Spiel gebracht. Insbesondere in den letzten beiden Jahrzehnten hat sich gezeigt, wie heterogen die Aufgaben sind, zu deren Bewältigung Menschenrechte herangezogen werden: Sie reichen von der Bedrohung des internationalen Terrorismus über die kulturelle Identitätsbehauptung als Bestandteil sozialer Spannungen bis zu neuen Formen der Meinungsäußerung durch soziale Medien. Hinzu kommt, dass es auch die Menschenrechte selbst sind, die Konflikte auslösen oder vertiefen. Der Band versammelt Beiträge, die die Anwendungsrelevanz der Menschenrechte in Situationen des inner- und zwischenstaatlichen Widerstreits aus interdisziplinärer Perspektive diskutieren: Wie lösen Menschenrechte Kulturkämpfe aus und wie können diese mit ihnen beendet werden? Gibt es eine Pflicht zur humanitären Intervention? Unter welchen Bedingungen darf das Menschenrecht auf Meinungsäußerungsfreiheit eingeschränkt werden? Welche Prinzipien sind die normativen Grundlagen des internationalen Menschenrechtsregimes? Mit Blick auf solche Fragen zeigen die Autorinnen und Autoren die Relevanz von Menschenrechten im Konflikt auf und verdeutlichen, weswegen jene selbst Gegenstand des Konflikts sind.

The German Empire of 1871, although unified politically, remained deeply divided along religious lines. In German Nationalism and Religious Conflict, Helmut Walser Smith offers the first social, cultural, and political history of this division. He argues that Protestants and Catholics lived in different worlds, separated by an "invisible boundary" of culture, defined as a community of meaning.As these worlds came into contact, they also came into conflict. Smith explores the local as well as the national dimensions of this conflict, illuminating for the first time the history of the Protestant League as well as the dilemmas involved in Catholic integration into a national culture defined primarily by Protestantism.The author places religious conflict within the wider context of nation-building and nationalism. The ongoing conflict, conditioned by a long history of mutual intolerance, was an integral part of the jagged and complex process by which Germany became a modern, secular, increasingly integrated nation. Consequently, religious conflict also influenced the construction of German national identity and the expression of German nationalism. Smith contends that in this religiously divided society, German nationalism did not simply smooth over tensions between two religious groups, but rather provided them with a new vocabulary for articulating their differences. Historians have long believed that Catholics were late and ambivalent supporters of the German nation. Rebecca Ayako Bennette's bold new interpretation demonstrates definitively that from the beginning in 1871, when Wilhelm I was proclaimed Kaiser of a unified Germany, Catholics were actively promoting a German national identity for the new Reich. In the years following unification, Germany was embroiled in a struggle to define the new nation. Otto von Bismarck and his allies looked to establish Germany as a modern nation through emphasis on Protestantism and military prowess. Many Catholics feared for their future when he launched the Kulturkampf, a program to break the political and social power of German Catholicism. But these anti-Catholic policies did not destroy Catholic hopes for the new Germany. Rather, they encouraged Catholics to develop an alternative to the Protestant and liberal visions that dominated the political culture. Bennette's reconstruction of Catholic thought and politics sheds light on several aspects of German life. From her discovery of Catholics who favored a more "feminine" alternative to Bismarckian militarism to her claim that anti-socialism, not anti-Semitism, energized Catholic politics, Bennette's work forces us to rethink much of what we know about religion and national identity in late nineteenth-century Germany.

"This book explores a vital though long-neglected clash between republicans and Catholics that rocked fin-de-siècle France. At its heart was a mysterious and shocking crime. In Lille in 1899, the body of twelve-year-old Gaston Foveaux was discovered in a school run by a Catholic congregation, the Frères des Écoles Chrétiennes. When his teacher, Frère Flamidien, was charged with sexual assault and murder, a local crime became a national scandal. The Flamidien Affair shows that masculinity was a critical site of contest in the War of Two Frances pitting republicans against Catholics. For republicans, Flamidien's vow of chastity as well as his overwrought behaviour during the investigation made him the target of suspicion; Catholics in turn constructed a rival vision of masculinity to exonerate the accused brother.
