Abstract

Twentieth-century Europe was an intense laboratory of capitalist experimentation. Confronted with economic booms and crises, technological revolutions, and economic globalization, Western Europe's governments constantly explored alternative ways of managing domestic economic systems and international commerce. Bridging comparative and international political economy, Creative Reconstructions compellingly expands our understanding of the historic relationship between varieties of capitalism and international cooperation.Orfeo Fioretos' pathbreaking analysis places multilateral institutions at the center of the study of capitalism. He highlights the role played by governments' multilateral strategies in shaping the national trajectories of capitalism in Great Britain, France, and Germany. Abstract

In 2014, the global economic system celebrates two anniversaries: Seventy years ago, on 22 July 1944 at Bretton Woods, New Hampshire, the Articles of Agreement of the International Monetary Fund (IMF) and the Articles of Agreement of the International Bank for Reconstruction and Development (Worldbank) were adopted. Since then the global financial and monetary system underwent significant policy changes, but the institutional framework remained the same. More recently, twenty years ago, on 15 April 1994, the Final Act of the Uruguay Round of Multilateral Trade Negotiations was signed and its key component, the Agreement establishing the World Trade Organization, entered into force on 1 January 1995. Even though the beginning of the multilateral trading system dates back to the late 1940s, the founding of the WTO constitutes a significant institutional reform which marks the beginning of a new era. Anniversaries are usually moments of celebration. However, even a superficial observer will notice that neither the current international financial and monetary regime nor the international trade regime is in a stage which invites celebration. Instead, both are facing difficult and fundamental challenges to their very existence from the outside but also from within. So while there may be no time to celebrate, anniversaries are also often used for reflection about the past and the future. Hence, EYIEL 5 (2014) considers these two anniversaries ample moments to reflect on the legacy and the current status of the main two pillars of International Economic Law in its Part one. Part two of EYIEL 5 (2014) brings together contributions on the EU’s Deep Trade Agenda, on Current Approaches to the International Investment Regime in South America, on the Multilayered System of Regional Economic Integration in West Africa and on the Tripartite Free Trade Area, as well as on India and her Trade Agreements. Part three contains treatises of developments in the World Customs Organization, the World Intellectual Property Organization and in International Investment Law. After the book reviews in Part four, EYIEL 5 (2014) is complemented with an Annex containing the Case (on exchange-rate manipulation and crisis-caused guarantees to financial institutions) and the Best Submissions of the 11th EMC2 ELSA WTO Moot Court Competition (of the Harvard team for the complainant and the Leuven team for the respondent). The case not only addresses issues of current interest but also links the subjects of our two special focusses nicely together.

Abstract

Like many other international organizations, the World Trade Organization stands at a crossroads. There is an obvious imbalance between the organization's dispute settlement arm and its negotiation platform. While its current rules, supported by a strong dispute settlement system, have provided some buffering against the negative effects of the financial crises, its negotiation machinery has not produced any substantial outcomes since the late 1990s. It has become obvious that the old way of doing business does not work any more and fresh ideas about governing the organization are needed. Based on rigorous scholarship, this volume of essays offers critical readings on the functioning of the system and provides policy-relevant ideas that go beyond incremental redesign but avoid the trap of romantic scenarios.

Abstract

The Handbook provides a detailed explanation and analysis of the process whereby governments become Members of the WTO. The WTO Agreement, which came into force on 1 January, 1995, provides few details on how this process is to take place. Consequently, the steps in the detailed negotiations leading up to access have evolved through the actual negotiations for governments which have become Members of the WTO since 1995. This handbook provides an account of how the process evolved and in offering details on the process as it is now applied. Moreover, the input of the WTO Secretariat into the preparation of the guide provides information not available until now to anyone outside the Secretariat. The Secretariat has supported production of this handbook in the hope it will serve as a useful source of reference for officials from acceding governments, WTO Members, academia, and the general public.

Abstract

This book argues that increasing engagement between international institutions and sectors of civil society is producing a new form of global governance. The authors investigate 'complex multilateralism' by studying the relationship between three multilateral economic institutions (the IMF, World Bank, and World Trade Organization), and three global social movements (environmental, labour and women's movements). They provide a rich comparative analysis of the institutional response to social movement pressure, tracing institutional change, policy modification and social movement tactics as they struggle to influence the rules and practices governing trade, finance and development regimes. The contest to shape global governance is increasingly being conducted upon a number of levels and amongst a diverse set of actors. Analysing a unique breadth of institutions and movements, this book charts an important part of that contest.
