La volonté. Voilà une notion qui est la croce e delizia de tout juriste. Elle n’a pas manqué de nourrir la réflexion depuis plusieurs siècles d’histoire juridique et suscite toujours des questionnements contemporains. La dimension diachronique, l’approche comparative et la réflexion collective sont au cœur des rencontres « France-Italie » depuis 2018. Par leur format original et l’ambition d’identifier et d’analyser la circulation des idées juridiques entre les deux pays et leurs juristes, les journées toulousaines de 2021 proposent d’interroger à nouveaux frais un thème déjà fécond. Les contributions réunies dans le présent volume ont permis de croiser les réflexions d’historiens du droit français et italiens pour saisir une notion qui n’est pas univoque ni un principe universel. Ils se sont également interrogés sur les moyens et les éléments qui ont façonné cette variabilité notionnelle en relation avec leur contexte d’élaboration et d’utilisation. Volonté individuelle et volonté collective, volonté juridique et volonté réelle sont quelques-unes des multiples facettes de la notion. Elles ont retenu l’attention d’une vingtaines de juristes historiens pour lesquels « l’une des tâches fondamentales de l’histoire du droit consiste à rappeler aux juristes que les principes et concepts généraux n’ont pas une signification absolue ou intemporelle ».

Dit boek biedt een overzichtelijke inleiding in het brede domein van de criminologie, die zelfstandig kan worden gelezen. Daarbij zijn noodgedwongen keuzes gemaakt in de behandelde onderwerpen, waarbij is gestreefd naar een breed overzicht, waarin ook Nederlandse ontwikkelingen voldoende aan bod komen. Sommige onderwerpen worden niet uitvoerig behandeld, maar in dat geval wordt verwezen naar relevante aanvullende literatuur. Verschillende onderwerpen die in het boek staan beschreven, zoals de ethiek van de opsporing, kritische stromingen binnen de criminologie, onder mijning en de principes van CPTED, ontbreken in de meeste handboeken. De auteurs gaan uitgebreid in op het gebruik van criminaliteitscijfers en geven een beknopt overzicht van gangbare onderzoeksmethoden in de criminologie. De derde druk is geheel geactualiseerd en aangevuld met actuele onderwerpen en voorbeelden.

L’importance de la pensée italienne de la race a été longtemps sous-estimée. Cependant, en Italie autant qu’en France ou en Allemagne, nombre d’œuvres littéraires ou de discours scientifiques mobilisent le concept de race dans une perspective aussi bien théorique que politique. Des premières décennies du xixe siècle à la période fasciste, trois moments – philologie romantique, anthropologie positiviste et idéologie fasciste – constituent les jalons d’une archéologie de la pensée italienne de la race dont l’étude révèle un usage spécifique qui engage non seulement le rapport que la Péninsule entretient avec l’autre mais aussi le rapport qu’elle entretient avec elle-même. The importance of the italian idea of race has been underestimated for a long time. Therefore, in Italy as well as in France or in Germany, a certain number of literary works or scientific discourses mobilise the concept of race in a theoretical and political perspective. From the first decades of the 19th century to the fascist period, three points – romantic philology, positivist anthropology and fascist ideology – prepare the ground of the Italian idea of race. The study of these points reveal a specific use engaging not only the relation the Peninsula maintains with the other but also the relation it maintains with itself.
