The principle of legal certainty is of fundamental importance for law and society: it has been vital in stabilising normative expectations and in providing a framework for social interaction, as well as defining the scope of individual freedom and political power. Even though it has not always been fully realised, legal certainty has also functioned as a normative ideal that has structured legal debates, both at the national and transnational level. This book presents research from a range of substantive areas regarding the meaning, possibility and desirability of legal certainty in the context of a rapidly changing global society. It aims to address these issues by bringing together scholars from various jurisdictions in order to examine changes in the shifting meaning of legal certainty in a comparative and transnational context. In particular, the book explores some of the tensions that now exist between the conventional expectation of legal certainty and the various challenges associated with regulating highly complex, late modern economies and societies. The book will be of interest to lawyers concerned with understanding the transformation of core rule of law values in the context of contemporary social change, as well as to political scientists and social theorists

The concept of 'real legal certainty' provides a much needed corrective to the general attention for legal certainty in this day and age. It emphasises relations between citizens, adds socio-legal insight, provides a 'view from below, ' and thus leads to more realistic insights on how to build state institutions. The concept was introduced by Leiden University's professor of Law and Governance in Developing countries Jan Michiel Otto, and can be considered a central pillar of his work. Against the backdrop of an ever-increasing interest in 'legal certainty' in policy-making and academia, friends and colleagues of Jan Michiel Otto engage with the concept provide a wide variety of examples of its relevance. Drawing on case material from all over the world, they show how real legal certainty can be understood in a bottom-up manner and how it is relevant for building state institutions. They also show how the concept can gain in relevance by taking into account actors other than the state. In all, the edited volume is important reading for all whom share professor Otto's interest in what it takes to bridge law in the books and law in action.

On Certainty continues Rescher's longstanding practice of publishing occasional studies that form part of a wider program of investigation of the scope and limits of rational inquiry in the pursuit of understanding. And pragmatism forms a subtextual Leitmotiv of these essays, seeing that the linking idea at work throughout is that knowledge is a tool for the management of our theoretical and practical affairs, and that what we ask of it is serviceability for the uses we have in view.

In this collection of original papers, leading international authorities turn their attention to one of the most important questions in theoretical philosophy: what is truth? To arrive at an answer, two further questions need to be addressed in this context: 1) Does truth possess any essence, any inner nature? and 2) If so, what does this nature consist of? The present discussion focuses on the antagonism between substantial or robust theories of truth, with correspondence theory taking the lead, and deflationist or minimalist views, which have been commanding an increasing amount of attention in recent years. Whereas substantial theories proceed from the premise that truth has an essence, and that therefore the objective is to discover this essence, the challenge presented by deflationism is to dispense with this very premise.

"In this book, Michael Lynch argues that truth does matter, in both our personal and political lives. Lynch explains that the growing cynicism over truth stems in large part from our confusion over what truth is." "True to Life defends four simple claims : that truth is objective; that it is good to believe what is true; that truth is a goal worthy of inquiry; and that truth can be worth caring about for its own sake - not just because it gets us other things we want. In defense of these "truisms about truth," Lynch diagnoses the sources of our cynicism and argues that many contemporary theories of truth cannot adequately account for its value. He explains why we should care about truth, arguing that truth and its pursuit are part of living a happy life, important in our personal relationships and for our political values."--Jacket.

Scharp proposes an account of the nature and logic of truth, in which truth is an inconsistent concept that should be replaced for certain theoretical purposes. He argues that truth is best understood as an inconsistent concept; develops an axiomatic theory of truth and offers a kind of possible-worlds semantics for this theory.
