Die Patientenautonomie gebietet es daher, dass der Patient in solche ärztlichen Behandlungsentscheidungen einwilligt. Wenn ein volljähriger Mensch wegen Krankheit oder Behinderung nicht über sich selbst bestimmen kann, werden Entscheidungen durch einen rechtsgeschäftlichen oder gesetzlichen Vertreter getroffen. Oftmals sind dies die Angehörigen. Diese werden aber auch häufig zum mutmaßlichen Patientenwillen befragt, wenn sie nicht zum Vertreter bestellt sind oder im Notfall der Vertreter nicht befragt werden kann. In solchen Fällen entscheiden die Ärzte über das Ob und Wie der Behandlung. Diese Arbeit untersucht, ob das Selbstbestimmungsrecht des Einzelnen die künftige Etablierung einer generellen Vertretungsbefugnis von Familienangehörigen gebietet und auf welcher rechtlichen Grundlage dies geschehen könnte. The book presents the first sustained theoretical analysis of what rights children should possess in connection with state decision making about their personal relationships which the state does in numerous aspects of family law, including paternity, adoption, custody and visitation, termination of parental rights, and grandparent visitation. It examines the nature and normative foundation of adults' rights in connection with relationships among themselves and then assesses the extent to which the moral principles underlying adults' rights apply also to children. It concludes that the law should ascribe to children rights equivalent (though not identical) to those which adults enjoy, and this would require substantial changes in the way the legal system treats children, including a reformation of the rules for establishing legal parent-child relationships at birth and of the rules for deciding whether to end a parent-child relationship.

This brief reference surveys the national policy of three representative African countries on the legal guardianship of children who are without parents or families. Focusing on the widely varying legal systems of Côte d’Ivoire, South Africa, and Uganda, the authors highlight guardianship as emblematic of the continent’s shortcomings in child protection laws.
