Abstract

What is it that really binds Dutch people together? That's the central question of many public debates.This study focuses on the the role of victimhood on our concept of society. Drawing on the works of the American philosopher Richard Rorty, the author discusses morality, criminality, religion, sexual abuse and legalisation of prostituiton. Wat bindt ons Nederlanders eigenlijk nog? Dat is de centrale vraag waar veel maatschappelijke debatten op uitlopen. In een ontzuilde tijd lijkt publieke moraal een individuele aangelegenheid te zijn. We vinden eerder overeenstemming in wat we afwijzen: wreeedheid, vernedering of discriminatie: slachtofferschap. Dat verklaart de belanstelling voor het slachtoffer in het strafrecht of de aandacht voor misbruikte kinderen. Dit spraakmakende boek is inmiddels jaren uitverkocht en wordt nu opnieuw uitgegeven. Paul Schnabel schreef destijds in NRC Handelsblad over 'een lichtgevend proefschrift [...] een fysieke ervaring om te lezen'. Het'Amsterdam Academic Archive is een initiatief van Amsterdam University Press. In de serie verschijnen (populair-)wetenschappelijke publicaties die niet meer leverbaar zijn, maar waarnaar nog wel vraag is in binnen- en buitenland.

"The aim of this book is to explore what response the law has or should have to different family practices arising from cultural and religious beliefs. The issue has become increasingly debated as western countries have become more culturally diverse. Although discussion has frequently focused on the role Islamic family law should have in these countries, this book seeks to set that discussion within a wider context that includes consideration both of theoretical issues and also of empirical data about the interaction between specific family practices and state law in a variety of jurisdictions ranging from England and Wales to Bangladesh, Botswana, Spain, Poland, France, Israel, Iran and South Africa. The contributors to the 17 chapters approach the subject matter from a variety of perspectives, illustrating its complex and often sensitive nature. The book does not set out to propose any single definitive strategy that should be adopted, but provides material on which researchers, advocates and policy makers can draw in furthering their understanding of and seeking solutions to the problems raised by this significant social development."--P. "What can popular cultures offer law, as a basis for critical practice? This introduction to the 'cultural legal studies' movement takes up this question as it presents a new encounter with the 'cultural turn' in law and legal theory. Moving beyond the 'law ands' (literature, humanities, culture, film) on which it is based, cultural legal studies aims to metamorphose law and the legalities that underpin its popular imaginary. To this end, the collection brings together leading scholars from Australia, Canada, the United Kingdom, and the United States. Presenting a long-overdue identification and framing of its scope, methodologies and practice, and drawing on three different modes of cultural legal studies - storytelling, technology and jurisprudence - the collection showcases the intersectional practices of cultural legal studies and law in its popular cultural mode. In this respect, contributors to the collection deploy differentiated modes of cultural legal studies practice, adopting diverse philosophical, disciplinary, methodological and theoretical approaches and subjects of examination. The collection draws on this mix of diversity and homogeneity to argue that we must take seriously an interrogation of law as culture- that is, not asking how a text 'represents'law, but how the representational nature of both law and culture intersect: in short, how the 'juridical' becomes visible in various cultural forms and their technological manifestations, and so how law's popular cultures actively metamorphose law.
