Abstract

The focus of this book, the legal situation created when an agent acts without authority, is one of the most important issues in agency law. The analysis is divided into three sections: apparent authority, ratification and the liability of the falsus procurator. Adopting a unique comparative perspective, the contributions are drawn from many different legal systems, providing the opportunity for analysis of the European common law/civil law divide. Abstract

Managing Knowledge reverses the status quo argument that organisational change is driven by the specific demands of large companies. Instead of viewing firms as the catalysts for gradual change, Albert and Bradley argue that expert professionals have fuelled a break away from the traditional organisational structure to an organisational structure at the heart of which is an agent and/or an agency system. The authors draw our attention to the growing phenomenon of atypical work manifested in workforce flexibility, mobility, the feminisation of professional employment, and technological changes. De Europese agentuurrichtlijn heeft binnen de Europese Unie een gemeenschappelijk kader gecreëerd voor het statuut van de handelsagent. Voor zover de lidstaten een minimale bescherming aan de handelsagent hebben verleend, blijft er echter ruimte voor bijzondere nationale voorschriften die voor principaal en agent verstrekkende gevolgen kunnen hebben.Voor alleenverkoop bestaat er van de andere kant in de meeste landen geen bijzondere wettelijke regeling, behalve in België. Toch heeft de rechtspraak in tal van landen ook aan de distributeur een minimumbescherming verleend. Deze publicatie biedt een juridische en fiscale analyse van het statuut van de handelsagent. Naast algemene concepten wordt een praktische checklist gegeven voor het opstellen van een internationaal agentuurcontract, met tal van voorbeelden en aandachtspunten. Het boek bevat een unieke modelovereenkomst voor internationale agentuur. In een tweede deel van het boek worden de specifieke nationale voorschriften van de Europese lidstaten en de belangrijkste handelspartners in Centraal- en Oost-Europa individueel uitgewerkt.Telkens is ook de tekst van de toepasselijke wetgeving opgenomen. Abstract

The early modern system of brokerage as a widespread practice of transmission and dissemination of political, intellectual and cultural ideas and objects has, in recent years, received some scholarly attention. Agents from different professional backgrounds – diplomats, scholars, artists, priests, booksellers and merchants – have, however, been studied mostly from a single, disciplinary perspective. The chapters making up this present volume all focus on individuals and professional groups who, in the course of their careers, became involved in multiple modes of cultural and political transfer. Together they present an international and interdisciplinary examination of early modern brokerage, a phenomenon which was permeating early modern society – and possibly even one of the fundamental organizational principles of that society.
