This book is the first ever comprehensive analysis of the scope and role of the exemption clause in Article 80 of the International Sales Convention (CISG). The book accounts for the historical background of Article 80, the relation to other provisions (Articles 77 and 79), the underlying principles and the connection to good faith, and argues that the provision is an expression of the duty to cooperate. Furthermore, the conditions for applying the exemption rule and the legal consequences of application are clarified to the benefit of any practitioner. A chapter on homeward trends points out some of the challenges that Article 80 poses to international uniformity. Extensive comparisons to UPICC and PECL are carried out. The book is relevant to scholars, adjudicators and practitioners alike.

Geschichten zu hören und zu erzählen ist ein Urbedürfnis der Menschen, nicht weit hinter Trinken, Essen und Schlafen. Warum das so ist, hat die Anthropologen bislang wenig interessiert. Doch nicht nur das Erzählen, als das wohl elementarste Format der Verarbeitung von Wahrnehmungen, Bedürfnissen und Erfahrungen, ist universal. Quer durch alle Kulturen findet sich eine Fülle übereinstimmender Motive, Plots und Genres. Warum ist das so? Der Erfolg einer Geschichte bemaß sich vor Erfindung der Schrift schlicht danach, ob sie weitererzählt wurde. Weitererzählt wurde, was den größten Anklang bei den Zuhörern fand; Ähnliches geschieht jetzt wieder in den massenmedial vermittelten Narrationen der modernen Populärkultur. Zu suchen ist also nach relevanten Dispositionen, die allen Menschen gemeinsam sind. Dazu werden zunächst mit den Mitteln der Literaturwissenschaft die universal beobachteten Elemente genauer beschrieben und auf ihre Zusammenhänge hin untersucht. Dies führt zur Identifizierung von fünf universalen "Strömen des Erzählens". Diese werden im Dialog mit anthropologisch einschlägigen Disziplinen wie Biologie und Psychologie auf universale menschliche Dispositionen bezogen.

Frank Neumann focuses on establishing a theoretical basis that allows a description of the interplay between individual and collective processes in product development. For this purpose, he introduces the integrated descriptive model of knowledge creation as the first constituent of his research framework. As a second part of the research framework, an analysis and modeling method is proposed that captures the various knowledge conversion activities described by the integrated descriptive model of knowledge creation. Subsequently, this research framework is applied to the analysis of knowledge characteristics of mechatronic product development (MPD). Finally, the results gained from the previous steps are used within a design support system that aims at federating the information and knowledge resources contained in the models published in the various development activities of MPD. The study of Kafka has been a respected field of research for many decades, and Gerhard Neumann is the best-known Kafka scholar. Seit der Jahrtausendwende gibt es auf der bundespolitischen Ebene in Deutschland ein eigens auf die Engagementförderung fokussiertes Politikfeld. Wie kam es dazu? Wer hat diesen Prozess forciert? Diesen Fragen geht Daniela Neumann durch eine Verknüpfung von Diskurs-, Hegemonie- und Gouvernementalitätstheorie auf den Grund.
