Abstract

As a primary trade route for more than half of the world's shipping, the location of potentially huge oil and gas reserves, and the main source of protein in maritime South- East Asia, the South China Sea is a governing determinant of security, prosperity and development in East Asia and the wider Indo-Pacific region. The disputes in the South China Sea have long been seen as a source of tension and instability in the region. Although peace has been maintained until now, the South China Sea is the epicentre of changes in the international balance of power which have the potential to trigger military conflict. The South China Sea sovereignty disputes are among the most complicated in the world and engage claims from Brunei, China, Malaysia, Philippines, Taiwan, and Vietnam. Given the complex convergence of national interests in the region, the prospect of settling the decades-old disputes completely is very slim.

Abstract

This book provides an explanation of Chinese policy towards the South China Sea, and argues that this has been sculpted by the changing dynamics of the law of the sea in conjunction with regional geopolitical flux. The past few decades have witnessed a bifurcated trend in China's management of territorial disputes. Over the years, while China gradually calmed and settled most land-border disputes with its neighbors, disputes on the ocean frontier continued to simmer in a seething cauldron. This book attributes the distinctive path of China's approach to maritime disputes to a unique factor - the law of the sea (LOS) as the 'rules of the road' in the ocean. By deconstructing the concept of 'sovereignty' and treating the LOS as an evolving regime, the book examines how the changing dynamics of the LOS regime have complicated and reshaped the nature and content of sovereign disputes in the ocean regime as well as the options of settlement. Applying the findings to the South China Sea case, the author traces the learning curve on which China has embarked to comprehend the complexity of the dispute accordingly and finds that it is the dynamic interaction of the law of the sea regime and the geopolitical conditions that has driven the evolution of China's South China Sea policy.

Abstract

L'Indo-Pacifique est actuellement la région qui concentre une part importante de la richesse mondiale. Ce dynamisme économique s'accompagne cependant de graves tensions politiques. Celles-ci se font jour particulièrement aux confins de cette région : la mer de Chine. Dans cette zone de l'Indo-Pacifique, la manifestation de la puissance chinoise se caractérise notamment par la volonté de la Chine d'assurer sa suprématie sur de vastes étendues maritimes. Il en résulte, entre les États côtiers de cette mer, des différends aussi bien territoriaux que relatifs à l'application et à l'interprétation de la Convention des Nations-Unies de 1982 sur le droit de la mer. Ces différends ont conduit ces États à entreprendre des travaux de poldérisation aux fins de transformer en îles des formations géologiques qui, pour l'essentiel, ne sont que des rochers ou des îlots. Cet ouvrage propose une étude de ces différends maritimes, jusqu'à présent peu traités en langue française.

Abstract

Over the past decade, the member countries of the Association of Southeast Asian Nations (ASEAN) have experienced dramatic economic growth. But economic transformation has created a number of new policy challenges, which the ASEAN governments must address as they prepare for the twenty-first century. New Challenges for ASEAN examines some of the most important policy issues confronting ASEAN governments. These include the degradation of the maritime and urban environments, new strains on inter-ethnic relations, domestic and international pressures to ensure the protection of human rights, growing barriers to trade with the outside world, and security concerns arising from a changing regional balance of power. The responses of the ASEAN governments to these challenges, at domestic, regional and international levels, are critically examined by a group of experts with longstanding interest in Southeast Asian affairs.

Abstract

This book focuses on the currently much-debated theme of the South China Sea disputes - one of the hottest international contentions over maritime territory of the 21st century which can easily turn from a brewing flashpoint into a regional conflict with global repercussions. Through a compilation of commentaries published by the S. Rajaratnam School of International Studies from 2012 to much of 2016, the book attempts to reflect the evolution of the disputes in recent years through what can be seen as turning points and trajectories in the diplomatic tensions. The book is divided into four sections each taking off from a key diplomatic or related incident or development which can be seen as a turning point. The concluding section looks at what lies ahead for Southeast Asia and the larger Asia-Pacific region, amidst the uncertainties triggered by the South China Sea imbroglio.
