Over the last twenty years research on guilds has freed itself from traditional clichés, such as the guilds' supposed backwardness and seclusion, and has thus paved the way for a new and more differentiated assessment of these historical institutions. Yet the subject matter remains far from being exhaustively studied. This book addresses some of the most disputed questions on craftsmen corporations, such as: the role of women and senior journeymen within guild structures, the interaction of guilds with local authorities and other urban institutions as well as their interrelations with local job markets and supra-local entrepreneurship. By combining more general theoretical reflections with micro-historical case studies the trilingual contributions do not only shed light on the institutional side of guilds but also on the individual actors within these corporations. By studying the phenomenon over a period of several hundreds of years (14th ? 18th century) the volume furthermore offers a long-term perspective on the research matter while its geographical spread offers points of reference for future comparative studies.

Once safety is involved, there seems to be an irresistible push towards more norms, procedures and processes, whatever the context. This book is not a plea against proceduralization, but it does take the view that it is time to reassess how far it can still go and to what benefit. There is a growing suspicion that the path taken might in fact lead to a dead end, unless the concept of procedure and the conditions under which procedures develop are revisited.

Graeco-Roman New Comedy has traditionally provided a source for legal historians examining the language and operation of law both in Athens in the fourth century and in Rome in the second century BC. Adele Scafuro here provides the first comprehensive treatment in English of one crucial area of this vast field, namely, the way legal disputes are settled out of court in Athens, both on and off the comic stage. Beginning with a close examination of pre-trial scenarios in the Attic orators and looking for comparable ones in pre-classical Roman law, Dr Scafuro then turns to the plays of Greek New Comedy and their adaptations by Plautus and Terence. There she identifies similar scenarios especially in disputes concerning sexual violations, the marriages of heiresses, and divorces. She shows how the recognition of legal procedures aids interpretation of New Comedy texts.

Le renouvellement des sources du droit peut être étudié sous deux aspects : qualitatif et quantitatif. Il y a renouvellement des sources du droit d’un point de vue qualitatif lorsque des sources d’une nouvelle espèce, d’un nouveau genre ou même d’une nouvelle nature apparaissent. Il y a renouvellement des sources du droit d’un point de vue quantitatif lorsque des sources préexistantes mais desquelles jaillissait peu de droit deviennent des fleuves de normes, au point de concurrencer les sources ordinaires de règles juridiques que sont la loi et la jurisprudence. En ce livre, le renouvellement des sources du droit est abordé sous l’un et l’autre angles, cela à l’aune d’une branche du droit particulière : le droit de la communication par internet. Observer cette forme de « droit global » est riche d’enseignements à l’égard de l’actualité et, plus encore, de l’avenir du droit. Ainsi de nouveaux objets normatifs, hier encore inconnus des juristes, peuvent ils être étudiés : codes privés, chartes, usages, conditions générales d’utilisation, contrats-types, normes managériales, normes techniques, mais aussi modes alternatifs de résolution des conflits, labels, standards, protocoles, meilleures pratiques, indicateurs, algorithmes, etc. Ces nouveaux objets normatifs et les phénomènes de « guerre des normes », de plurinormativité et d’internormativité qui les accompagnent interrogent l’orthodoxie juridique moderne mais aussi et plus fondamentalement l’État de droit, la démocratie, certains droits et libertés fondamentaux ou encore l’intérêt général. L’internet a condensé le temps et dilué l’espace. Il a ainsi profondément transformé les sociétés ; et l’univers juridique, dans ses différentes dimensions, est nécessairement affecté. Aussi la fréquentation de son droit invite-t-elle à élaborer de nouveaux outils afin de décrire et expliquer les « faits normatifs » qui le constituent. L’observation du droit de la communication par internet est ici au service d’une réflexion…

This book is a guide to the law that applies in the three international criminal tribunals, for the former Yugoslavia, Rwanda and Sierra Leone, set up by the UN during the period 1993 to 2002 to deal with atrocities and human rights abuses committed during conflict in those countries. Building on the work of an earlier generation of war crimes courts, these tribunals have developed a sophisticated body of law concerning the elements of the three international crimes (genocide, crimes against humanity and war crimes), and forms of participation in such crimes, as well as other general principles of international criminal law, procedural matters and sentencing. The legacy of the tribunals will be indispensable as international law moves into a more advanced stage, with the establishment of the International Criminal Court. Their judicial decisions are examined here, as well as the drafting history of their statutes and other contemporary sources.
