This collection of essays assesses the legacy established by the most important international criminal tribunal since the Nuremberg and Tokyo war crimes trials, and considers what might be done to enhance or modify the legacy of the International Criminal Tribunal for the former Yugoslavia (ICTY), including improvement of the capacity of state courts in the region to prosecute violations of humanitarian law by using the Tribunal’s documents, evidence, law, and practice. The essays are derived from a conference, Assessing the Legacy of the ICTY , which was convened in The Hague. Participants included over 375 stakeholders from the former Yugoslavia; officials from the Tribunal’s Chambers, Registry, and the Office of the Prosecutor; justice ministers and other government officials from Europe; and all elements of civil society—representatives of nongovernmental organizations, lawyers, and academics.

Abstract

The fall of the United Nations 'safe area' of Srebrenica in July 1995 to Bosnian Serb and Serbian forces stands out as the international community's most egregious failure to intervene during the Bosnian war. It led to genocide, forced displacement and a legacy of loss. But wartime inaction has since spurred numerous postwar attempts to address the atrocities' effects on Bosnian society and its diaspora. Srebrenica in the Aftermath of Genocide reveals how interactions between local, national and international interventions - from refugee return and resettlement to commemorations, war crimes trials, immigration proceedings and election reform - have led to subtle, positive effects of social repair, despite persistent attempts at denial. Using an interdisciplinary approach, diverse research methods, and more than a decade of fieldwork in five countries, Lara J. Nettelfield and Sarah E. Wagner trace the genocide's reverberations in Bosnia and abroad. The findings of this study have implications for research on post-conflict societies around the world.

Abstract

At the dawn of the International Criminal Court, the rich experience of the ad hoc International Criminal Tribunal for the former Yugoslavia (ICTY) will prove to be the primary source of legal authorities for many years. The creation of the ICTY in 1993 heralded a new-found willingness of the international community to bring to book perpetrators of war crimes and gross or systematic violations of human rights. Abstract

When Slobodan Milošević died in the United Nations Detention Unit in The Hague over four years after his trial had begun, many feared - and some hoped - that international criminal justice was experiencing some sort of death itself. Yet the Milošević case, the first trial of a former head of state by a truly international criminal tribunal and one of the most complex and lengthy war crimes trials in history, stands for much in the development and the future of international criminal justice, both politically and legally. This book, written by the senior legal advisor working for the Trial Chamber, analyses the trial to determine what lessons can be learnt that will improve the fair and expeditious conduct of complex international criminal proceedings brought against former heads of state and senior political and military officials, and develops reforms for the future achievement of best practice in international criminal law.

Abstract

This book is a guide to the law that applies in the three international criminal tribunals, for the former Yugoslavia, Rwanda and Sierra Leone, set up by the UN during the period 1993 to 2002 to deal with atrocities and human rights abuses committed during conflict in those countries. Building on the work of an earlier generation of war crimes courts, these tribunals have developed a sophisticated body of law concerning the elements of the three international crimes (genocide, crimes against humanity and war crimes), and forms of participation in such crimes, as well as other general principles of international criminal law, procedural matters and sentencing. The legacy of the tribunals will be indispensable as international law moves into a more advanced stage, with the establishment of the International Criminal Court. Their judicial decisions are examined here, as well as the drafting history of their statutes and other contemporary sources.
