Jo M. Pasqualucci provides a comprehensive critique of the Inter-American Court of Human Rights, which is at once scholarly yet practical. She analyzes all aspects of the Court's advisory jurisdiction, contentious jurisdiction, and provisional measures orders. When relevant, she compares the practice and procedure of the Inter-American Court with that of the European Court of Human Rights, the International Court of Justice, and the United Nations Human Rights Committee. She also evaluates the Rules of Procedure of the Inter-American Court and the Inter-American Commission, which entered into force in May and June of 2001 and bring about important procedural changes in the inter-relationship of those organs. In addition, she cites the effectiveness of the Convention and the Court's rulings in the domestic law of the States Parties to the Convention. En el presente texto se analizan problemas, soluciones y representaciones en torno a los derechos humanos, fruto de investigaciones terminadas. Con relación a los problemas, el capítulo I estudia la concepción individualista de los derechos humanos que dificulta su implementación efectiva, mientras el capítulo II reflexiona acerca del comportamiento del Estado colombiano ante el Sistema Interamericano de Derechos Humanos que impacta negativamente en la garantía de los derechos de las víctimas. Respecto a las soluciones, varios capítulos se ocupan de algunas políticas públicas destinadas a la población víctima del conflicto armado y el desplazamiento forzado interno. Tal es el caso de los capítulos VII y VIII los cuales analizan, respectivamente, las estrategias de intervención psicosocial dirigidas a la promoción y fortalecimiento de la salud mental en población víctima de violencia sociopolítica y las acciones que el Estado colombiano ha desarrollado con el propósito de garantizar los derechos de las personas con discapacidad en el contexto de guerra interna. En cuanto a las representaciones acerca de los derechos humanos y su vulneración, los cuatro capítulos de la segunda sección de esta publicación dan cuenta de las vivencias y las interpretaciones de algunos niños y niñas del Colegio Jorge Soto del Corral de Bogotá acerca del conflicto armado y el desplazamiento forzado interno. International politics has become increasingly legalized over the past fifty years, restructuring the way states interact with each other, international institutions, and their own constituents. The international legalization of human rights now makes it possible for individuals to take human rights claims against their governments at international courts such as the European and Inter-American Courts of Human Rights. This book brings together theories from international law, human rights and international relations to explain the increasingly important phenomenon of states' compliance with human rights tribunals' rulings. It argues that this is an inherently domestic affair. It posits three overarching questions: why do states comply with human rights tribunals' rulings? How does the compliance process unfold and what are the domestic political considerations around compliance? What effect does compliance have on the protection of human rights? The book answers these through a combination of quantitative analyses and in-depth case studies from Argentina, Brazil, Colombia, Italy, Portugal, Russia and the United Kingdom.
