"Norms beyond Empire seeks to rethink the relationship between law and empire by emphasizing the role of local normative production. While European imperialism is often viewed as being able to shape colonial law and government to its image, this volume argues that early modern empires could never monolithically control how these processes unfolded. Examining the Iberian empires in Asia, it seeks to look at norms as a means of escaping the often too narrow concept of law and look beyond empire to highlight the ways in which law-making and local normativities frequently acted beyond colonial rule. The ten chapters explore normative production from this perspective by focusing on case studies from China, India, Japan, and the Philippines. This anthology centers on the visual representation of woman in early modern Latin America, that is, the social and cultural construction and definition of female identity as evidenced by the art document. Artists in this period were collectively aware of a vocabulary of gender that could be tailored to deliver varying messages about the position of women in vice regal culture and society. This volume is organized not in the predictable linear framework, by periods and centuries, but rather by the realization that throughout much of this period, Spanish authorities and others envisaged the Spanish colonies of the Americas in gendered terms. Proffered as the female body, the “New” (virginal by implication) World was at differing times adored, pursued, courted, seduced, defiled, exploited, reviled, and denounced by those (males) who encountered “her.” This mentality is born out in the various forms of female representation that are discussed in this fully illustrated book. On page 194, second paragraph, third sentence, should read: “Marina’s absence in the encounter painting, where she normally mediates contact between the men, emphasizes the phallogocentric aspect of the historic meeting.” The original phrasing, using the pivotal term, ‘phallogocentric’ (a reference to a gendered form of exchange or communication) was changed to ‘phallus-centered,’ which not only alters a central idea in the argument, but actually has nothing to do with the image in question.

Latin American Constitutions provides a comprehensive historical study of constitutionalism in Latin America from the independence period to the present, focusing on the Constitution of Cádiz, a foundational document in Latin American constitutionalism. Although drafted in Spain, it was applied in many regions of Latin America, and deputies from America formed a significant part of the drafting body. The politicization of constitutionalism reflected in Latin America's first moments proved to be a lasting legacy evident in the legal and constitutional world of the region today: many of Latin America's present challenges to establishing effective constitutionalism can be traced to the debates, ideas, structures, and assumptions of this text. This book explores the region's attempts to create effective constitutional texts and regimes in light of an established practice of linking constitutions to political goals and places important constitutional thinkers and regional constitutions, such as the Mexican Constitution of 1917, into their legal and historical context.

This is an archaeological and historical study of Mexico City and Xaltocan, focusing on the early years after the Spanish conquest of the Aztec empire in 1521. The study of households excavated in Mexico City and the probate inventories of 39 colonizers provide a vivid view of the material and social lives of the Spanish in what was once the capital of the Aztec empire. Decades of archaeological and ethnohistorical research in Xaltocan, a town north of Mexico City, offers a long-term perspective of daily life, technology, the economy, and the adoption of Spanish material culture among indigenous people. Through these case studies, this book examines interpretive strategies used when working with historical documents and archaeological data. Focusing on the use of metaphors to guide interpretation, this volume explores the possibilities for interdisciplinary collaboration between historians, archaeologists, and anthropologists working on this pivotal period in Latin American history.
