Humanity is struggling with ever larger amounts of data, which is not only annoying but also an existential problem in the information society. Remarkably, the law has so far hardly addressed this problem of excessive information. This essay compiles the legal regulations that exist at certain points. Legal approaches to solving the abundance of information are formulated, but warned of the associated restriction of freedom.

Die Vergütung für die Nutzung von Werken ist aus Sicht der Urheber und Künstler seit jeher einer der wichtigsten Aspekte des Rechtsschutzes und erhält derzeit in Bezug auf Internet-Nutzungen wieder eine besondere Aktualität. Gerade für Urheber und Künstler, jedoch auch für Verwerter wie Tonträgerhersteller, ist es höchst problematisch, dass sie bisher meist keine adäquate Vergütung für Internetnutzungen erhalten. Sogar die Europäische Kommission hat das Thema in ihrer jüngsten Mitteilung aufgegriffen. Der Band des ALAI-Kongresses, der 2015 in Bonn stattfand, untersucht die unterschiedlichen Gründe und Lösungsmöglichkeiten dafür – sei es aufgrund von ausschließlichen Rechten oder auch von Vergütungsansprüchen, wie sie erstmalig in Deutschland für die Privatkopie eingeführt wurden. Darüber hinaus werden verschiedene Geschäftsmodelle für die Werkverwertung im Internet im Hinblick auf den Aspekt der Vergütung vorgestellt. Der Band ist ein wertvoller Beitrag zu diesem sehr aktuellen Thema.Der Band enthält meist englische, jedoch auch französische und spanische Beiträge. Royalty payments are once again becoming a hot button issue for authors and artists, as well as other holders of copyright or related rights, because they fail to receive adequate compensation for the use of their work on the internet. This volume from the 2015 ALAI Congress contributes to the international discussion of this issue by examining the causes of the problem and possible solutions, including a set of business models to compensate for internet usage. The volume contains mainly English as well as French and Spanish contributions.

This open access book addresses communicative aspects of the current COVID-19 pandemic as well as the epidemic of misinformation from the perspective of argumentation theory. Argumentation theory is uniquely placed to understand and account for the challenges of public reason as expressed through argumentative discourse. The book thus focuses on the extent to which the forms, norms and functions of public argumentation have changed in the face of the COVID-19 pandemic. This question is investigated along the three main research lines of the COST Action project CA 17132: European network for Argumentation and Public PoLicY analysis (APPLY): descriptive, normative, and prescriptive. The volume offers a broad range of contributions which treat argumentative phenomena that are directly related to the changes in public discourse in the wake of the outburst of COVID-19. The volume additionally places particular emphasis on expert argumentation, given (i) the importance expert discourse has had over the last two years, and (ii) the challenges that expert argumentation has faced in the public sphere as a result of scientific uncertainty and widespread misinformation. Contributions are divided into three groups, which (i) examine various features and aspects of public and institutional discourse about the COVID-19 pandemic, (ii) scrutinize the way health policies have been discussed, debated, attacked and defended in the public sphere, and (iii) consider a range of proposals meant to improve the quality of public discourse, and public deliberation in particular, in such a way that concrete proposals for argumentative literacy will be brought to light. Overall, this volume constitutes a timely inquiry into all things argumentative in pandemic discourse. This volume is of interest to a broad readership including philosophers, linguists, communication and legal scholars, and members of the wider public who seek to better understand the discourse surrounding communicative phenomena in times of crisis.

L'économie se fonde de plus en plus l'immatériel, et l'innovation est au cœur de toutes les préoccupations. Chacun s'accorde pour dire que l'effort de recherche est une solution sans alternative pour la France et pour l'Europe confrontées à la concurrence et au dynamisme économique des pays émergents qui les dépossèdent de plus en plus de l'aspect manufacturier de la production. La recherche est créatrice des emplois de demain, entend-t-on dire souvent, et elle débouche sur des produits nouveaux, des médicaments plus efficaces, des services plus performants,... qui augmentent le bien-être social. Or, la valorisation de la recherche passe par le droit et ses outils (contrats, structures, collaborations,...). Le droit intervient aussi dans la définition du statut du chercheur, dans la garantie de la liberté de la recherche et dans la détermination de ses limites. Il fournit les éléments qui permettent de répartir les résultats entre employeurs et salariés. C'est aussi le droit qui propose, notamment au nom du principe de précaution, les moyens pour encadrer les pratiques des laboratoires. Car si les avancées de a recherche ouvrent souvent des perspectives merveilleuses, elles suscitent aussi beaucoup d'inquiétudes (OGM, nanotechnologies, manipulations génétiques sur l'humain,...).
