Nach den ungewöhnlich vielen Änderungen der letzten Zeit erscheint die Reform des Sexualstrafrechts mit dem SexÄndG im Wesentlichen als abgeschlossen. Das neue Sexualstrafrecht wird hiermit erstmals in einer systematischen Darstellung vorgelegt, die Praxis und Lehre zur Orientierung dienen soll. Die Strafvorschriften des StGB, des ProstG sowie des TDG sind mit abgedruckt. Eine systematische Darstellung ist notwendig geworden, weil die zahlreichen Änderungen das Sexualstrafrecht und dessen Systematik unübersichtlich werden ließen. Dies führt zu praktischen Problemen, insb. bei der Auslegung der einzelnen gesetzlichen Merkmale, aber auch bei der Abgrenzung der verschiedenen Tatbestände voneinander. Dem Werk gelingt es, diese Problemgebiete aufzuhellen und praxisgerechte Lösungsvorschläge zu entwickeln. Diesem Zweck dient auch der Abdruck der amtlichen Begründungen zum 33. StrRÄndG und zu den beiden letzten größeren Reformgesetzen, dem 6. StrRG und dem SexÄndG. Zur Erleichterung der Ermittlung der zur jeweiligen Entscheidungsfindung heranzuziehenden Gesetzesfassung dient der in der Einführung gebotene kurze Abriss der Gesetzgebungsgeschichte und die Auflistung der wichtigsten Reformgesetze, aber auch die der Erörterung der einzelnen Tatbestände jeweils vorangestellte knappe Geschichte ihrer Änderungen. Die vorliegende Darstellung bietet allen, die in ihrer täglichen Praxis mit Fragestellungen des Sexualstrafrechts befasst sind, Orientierungs- und Entscheidungshilfe. Sie richtet sich aber auch an Lehrende und Lernende. [Gössel: Sexual Criminal Law]After the unusual multiple changes of recent times, the reform of the sexual criminal law appears to be essentially concluded with the SexÄndG [Sexual Amendment Act]. The new sexual criminal law is hereby presented for the first time in a systematic presentation that shall serve as orientation for practice and teaching. The penal provisions of the StGB [Criminal Code], the ProstG [Prostitution Law] and the TDG [Teleservice Law] are also printed with this presentation. A systematic presentation became necessary since the numerous changes to the sexual criminal law and its methods had become confusing. This led to practical problems, especially with regard to the interpretation of the individual statutory features, but also with regard to the differentiation of the various circumstances. The work has successfully managed to shed light on these problem areas and to develop practical solution proposals. The reprint of the official substantiations pertaining to the 33rd StrRÄndG [Criminal Law Amendment Act] and to the two latter reform laws - the 6th StRG [Penal Reform Act] and the SexÄndG - also serves this purpose. The brief outline of the legislative history offered in the introduction and the listing of the most important reform laws - but also the discussion of the individual circumstances respective to the prefixed concise history of their changes - serves for facilitation of the determination pertaining to the respective decision-making to be derived from the version of the law. The presentation at hand offers orientation and decision-making aids for all those who are concerned with questions pertaining to sexual criminal law in their daily practice. However, it is also addressed to teachers and students.

Few crimes capture the interest and attention of the public as sexual driven crime. Relapsing sex offenders especially spark debates on how best to deal with this particular group. Incidents of serious sexual crimes are, fortunately, rare in Germany which partly complicates empirical research into sexual criminality. This study aims to contribute to an understanding of sexual crimes by providing an overview of such offences in Germany by nature of the offence, offender-types, penalties and (partially) criminal careers from the perspective of judicial oversight of sexual crime. The study examines 9,430 sexual offenders from all over Germany based on data from the Federal Central Criminal Register where either custodial sentences were served or non-custodial sanctions imposed in the base year. It tracks the sample group over six years comparing their outcomes with other non-sexual offender types.
