La première ambition de cet ouvrage est de contribuer à la construction de l'Europe en partant de la base, c'est-à-dire des Etats nationaux. Ce sont eux qui doivent consentir aux concessions, voire aux sacrifices nécessaires pour agir ensemble. L'auteur souhaite que les juristes d'Europe puissent se comprendre en comprenant les conceptions fondamentales sous-jacentes aux diverses constructions juridiques nationales pour oeuvrer à un rapprochement des systèmes juridiques et favoriser cette construction européenne indispensable.

The frontier between 'law' and 'politics' is not always clear-cut. A large area exists where courts operate, but where governments and parliaments also make decisions. Tim Koopmans compares the way American, British, French and German law and politics deal with different issues: in many instances subjects which are highly 'political' in one country constitute legal issues in another. Is there, for example a 'sovereign Parliament' (as there is in Britain), or will courts control the compatibility of statutes with the Constitution (as in the United States and Germany)? How far can courts go in controlling the legality of administrative action? Are there general legal theories about the frontier between what courts and what politics can do? Koopmans considers case law on a range of issues, including human rights protection, federalism, separation of powers, equal protection and the impact of European and international law.

L'étude des arrêts de la Cour européenne des droits de l'homme d'une part, de la Cour suprême des Etats-Unis d'Amérique de l'autre révèle la fluctuation de la protection de la liberté d'expression. Ces divergences d'un système à l'autre, mais également à l'intérieur d'un même système, montrent que la question des limites de la liberté de parole – qui est inévitablement un lieu de confrontation d'intérêts contraires – ne peut être posée en dehors du contexte particulier dans lequel elle se présente. Celui-ci se laisse décrire en quatre variables : l'auteur, le message, le lieu ou le moyen d'expression, et la réaction mise en œuvre. Chaque variable connaît un certain nombre de déclinaisons (par exemple, l'auteur peut être journaliste, politicien, artiste, fonctionnaire, …). Le fil conducteur du présent travail comparatif consiste à déterminer l'importance de ces différents facteurs de variation dans la détermination par les juges européens et américains du niveau de protection de la liberté d'expression.

Multinational Democracies is the first collaborative, multiperspective critical survey of a new and distinctive type of political association that is coming into prominence in the twenty-first century. These are democratic societies that are not only multicultural but also multinational: that is, they comprise two or more nations. Fifteen leading comparative political scientists and political theorists from Europe and North America clarify the complex character and tensions of multinational democracies by reflecting on four exemplars - the United Kingdom, Spain, Belgium and Canada. The work offers a new approach to the study, understanding and governing of multinational societies and, in so doing, of culturally diverse societies more generally. This volume will be of interest to those concerned with diverse societies, nationalism, struggles for recognition, federalism and democratic constitutionalism in conditions of pluralism.
