Les États ne prennent pas volontiers le risque de s'engager sans limite à respecter des règles, conventionnelles ou autres, destinées à régir durablement les relations qu'ils entretiennent dans un certain domaine. D'engagements de cette sorte, valant sans limitation de durée ou même pour une durée déterminée mais telle que leur portée ne puisse être évaluée à l'avance avec un minimum de prévisibilité, peuvent résulter des charges jugées excessives par un État, qui justifieraient qu'il soit libéré, définitivement ou seulement pour faire face à des circonstances momentanées, d'obligations dont l'exécution imposerait à l'État, durablement ou non, une charge qu'il jugerait excessive. Parmi ces techniques, deux types retiennent spécialement l'intérêt, l'extinction et le retrait d'une part, la suspension de l'application de l'autre. Si le premier type fait l'objet d'une attention soutenue de la doctrine, elle s'est peu attachée au second, et le droit international général, tel que le recense la convention de Vienne sur le droit des traités dans sa V' partie, les soumet à des règles très largement communes, alors qu'ils poursuivent des fins et remplissent des fonctions différentes ; ils font d'ailleurs l'objet de dispositions beaucoup plus différenciées dans la pratique des clauses qui déterminent dès la conclusion de l'engagement le genre de circonstances, prévisibles celles-là, qui pourraient justifier le recours aux unes ou à l'autre. Une étude de la suspension peut prendre appui sur le recensement et l'analyse de cette pratique. La thèse de Nathalie Clarenc constitue la première tentative de systématisation de la suspension, considérée comme un mécanisme autonome, offrant un moyen de concilier, dans l'intérêt de l'État en cause comme dans celui de ses partenaires, le maintien du lien conventionnel et la libération, durant une période limitée, du poids que représente la soumission aux obligations qui en résultent pour l'État lorsqu'il rencontre des difficultés momentanées. Présentée comme une « désactivation » provisoire du lien conventionnel, la suspension réduit la portée de l'engagement initial de l'État, dont seuls certains aspects, liés à la qualité de partie, lui restent opposables, tandis que les obligations substantielles qu'il comporte, ou certaines d'entre elles, cessent de l'être durant la suspension ; en évitant que le lien résultant de l'engagement ne soit rompu, la technique de la suspension lui permet de reprendre sa pleine efficacité une fois disparues les circonstances qui ont conduit à y recourir.
